I don't think Winston's contact with the official was malicious, but was definitely intentional and against the rules. I'm about 50/50 on whether it should've resulted in an ejection or just a 15-yard penalty.

So getting emotional excuses negative behavior these days? Jimbo is a clown. If he realy believes this stuff, well, that's sad and says alot about his morales and character.

Maybe Brian Kelly can use that argument with the refs the next time Nyles Morgan or Max Redfield get flagged for targeting and ejected from the game.

So ... when does "unintentional" come into play when it comes to offsides, illegal formation, too many players on the field, encroachment, etc., etc., etc.

There is no excuse for that not being, at the very minimum, a 15 yard penalty. I just don't get it.

The recent shooting at FSU was a bad thing, and this is how bad JW's reputation is now. When the news broke about the shooting, the first word's out of my wife's mouth was, "Was that football player involved?"

Also, gotta love espn, I had to go to the bottom of the NCAAF page on espn mobile to see anything about the hearing.
They don't even have it in the top 5 NCAAF stories.

He did not testify. Same as he refused to answer any questions from the police initially, and from anyone involved in the situation. Seems odd to me.

Florida State quarterback Jameis Winston's student conduct code hearing ended Wednesday without the quarterback testifying to allegations that he sexually assaulted a woman nearly two years ago, sources close to the case confirmed to ESPN.com.

Winston, the reigning Heisman Trophy winner, made a closing statement, but didn't answer questions from retired Florida State Supreme Court Chief Justice Major Harding during the two-day hearing. Harding is considering whether Winston committed as many as four violations of FSU's student conduct code, including two related to sexual misconduct, for his actions during a sexual encounter with the woman in December 2012.

He doesn't, and shouldn't, give 2 shits about this "hearing." He will leave school after the season at the latest and enter the draft. There is no benefit to him testifying. Had he testified, his words could be used against him in a real civil court.

Or a criminal court, I believe, since he was never charged in the first place and wouldn't be protected by "double jeopardy."
Either way, you're right. Testifying could only hurt him, since his college career will be done in a month. He did give his version of events in a statement, though. Probably mostly for PR purposes, and certainly well-lawyered.

One of the attorneys here please correct me if I'm wrong, but the burden of proof in this hearing is significantly lower than in a criminal case or even a civil case, isn't it? Can't his refusal to testify hurt him in this? Can the judge in this hearing take it as an unwillingness to cooperate and a tacit admission of guilt?

I have been on both the legal and civil side dealing with these situations. The burden is a preponderance of evidence which is most similar to over 50 percent or more likely than not. Yet, him not testifying will and should not hurt him. At the same point in time it is less convincing then telling your story. The victim gets to tell her entire story and any question can be asked of her. Also another problem/benefit of these hearings (depending on how one would look at it) is that there are no rules of evidence and any questions can be asked by the judge who is making the decision.

Florida State University late Monday asked a federal judge to throw out a lawsuit filed by a former student who said top NFL prospect Jameis Winston sexually assaulted her back in 2012.
The woman filed a lawsuit against the university board of trustees in January, asserting that university officials had knowledge of her alleged sexual harassment and discrimination by the star quarterback and this created a hostile educational environment for her. The lawsuit seeks unspecified damages, including reimbursement for tuition, damages for emotional pain and suffering and loss of past and present earning and earning capacity.
Lawyers for the university's board of trustees contend the lawsuit should be dismissed because it does not show that FSU was responsible for her harassment, but they also maintain that they offered her assistance.
But the court filing also asserts that while the woman was provided services by the school's victim advocate, no top officials at the school were even aware that she had accused Winston of rape until a few days before the case became public in November 2013.
The woman wound up leaving school after the investigation against Winston was reported. Winston was not charged by prosecutors in 2013 and he was cleared by the university following a two-day student conduct hearing last year. University lawyers maintain FSU was not responsible for the treatment that she received once news about the investigation became public.
''Regrettably the media's reporting of (the woman's) allegations led to an Internet and social media backlash — harassment that FSU did not cause and in an environment that FSU could not control,'' states the FSU court filing.

Normally, The Associated Press does not identify the names of people who say they were sexually assaulted.
Winston is expected to be one of the first quarterbacks selected in the NFL Draft, but faces questions about this case and other off-the-field incidents.
In her lawsuit, the woman said that both FSU coach Jimbo Fisher and a senior athletic department official learned from police that Winston was a suspect in a rape investigation in January 2013 — which was months before Tallahassee police handed over the case to a local prosecutor.
But FSU's lawyers said this is ''insufficient to establish actual knowledge on the part of FSU'' and that her lawsuit does not show that Fisher and senior associate athletics director Monk Bonasorte knew her identity or that she was a student.

Payday...don't blame her at all...

If she were smart she'd be seen in the public forum with that crazy lawyer chick gloria alred...just enough to make the NFL start to pucker up, but not enough to stop a first round selection...

The Winston camp will be under INTENSE pressure from the NFL to settle that shit . Uncle Roger can't take any more of these deals being handled in the media...

The Cardinals are from Chicago, we can always switch to them. They don't have a qb either, so it will be easy to feel right at home.
