I now have a sneaking suspicion that the RayBans and Gucci bag I bought from him aren't really RayBans nor Gucci.

Seems kinda harsh for a first punishment. He has been warned, but a month as the first punishment is 4x what people usually get when they are being total asses. He admittingly posts those updates from his phone, so it very well may have been accidental as well.

The funny part is that the info he posted is posted immedietely under his deleted post, just not cut and pasted.

I also would have thought that a poster as good as him would have been cut more slack, I guess. There are people on here that are downright awful (i'm looking at you connectthedots) that don't even get warned when they post abusive comments. But then Panda gets the boot for a month for forgetting to cite a link?

To be honest, I've completely dropped the ball on watching for copyright infringement. I don't recall other mods addressing it either recently. And Jason isn't online nearly as frequently as we are. So any inconsistency in enforcement here is likely a function of Jason's busy schedule, and not selectivity by the mods. We need to do better, though.

Has he ever been told to take a break from posting any articles or updates for a period of time? Has he ever had any type of punishment before the month ban?

I'm not privy to the conversations before the ban, but it seems like he was verbally warned a few times then given the month boot. Is there more to the story than that?



Panda is one of my favorite posters on here.

The first few times, you could chalk it up to ignorance of what is and is not infringement, but we've PM'ed him several times, including twice over the last week, with a clear explanation of how what he's been posting could expose the board to copyright liability and detailed advice for how to post information gleaned from articles in the future. Each time he's responded with a "ok, no problem" but there clearly is a problem if there has not been a change in what he posts.

It's not a matter of merely forgetting to cite a link and your minimizing what constitutes infringement does not minimize that posting any substantial amount of text of an article, even with proper attribution, could be considered infringement. The potential liability and the law does not stop for how "dumb as f*ck" you think it is.

For the record, I didn't call it "dumb as f*ck", I said that to Koon about his comment regarding Pat. It was also just a joke, as that is usually how I talk to Koon. He knows that. I didn't use that comment in regards to you or the decision.

I get the copyrite infringement, I understand the history with it, but I still feel the same. A month is harsh for what he did, imo. There were other alternatives that I believe would have been more appropriate for someone like Panda. I guess I just feel like it would have been easier to tell him that he wasn't allowed to post any articles, links or updates for a period of time or something. Again... while poor behavior doesn't risk the livelihood of the site, those people usually get a week or less. But you are the boss and it is what it is. I'll leave it alone...

I guess I just miss my friend...

I can definitely sympathize with this. The guy is a good poster who is consistently on top of getting information out there to the board. The boot isn't at all a personality or comportment thing; we've just got to take infringement seriously, we've tried and failed several times to communicate the seriousness of infringement and its consequences, so this was the next step in the progression of trying and failing to have that conversation.

House arrest, he's not allowed to leave the lounge until he proves he can obey the rules. I don't even remember what he was banned for anymore.

Copyrights do not protect facts or ideas; they do however protect the way in which a person has chosen to express those facts or ideas. First, a summary or paraphrase of an article is generally above board (e.g. if an article stated that "Blake Barnett raved about Oregon academics and noted in particular the fantastic 60% rate at which the Pac-12 school graduates its student-athletes", you could post that "An Oregon fan named Justin Hopkins reports on 247 that Blake Barnett was impressed by the academics and graduation rates at Oregon.")

Second, quotes and snippets from articles are allowed only if they are very limited and done for the purpose of commentary or critique (e.g. "In a recent article, Justin Hopkins wrote that 'I am not a Duck homer.' Likely story, broseph.") and only if they are properly attributed. With that in mind, posting substantial parts of an article and posting snippets without further commentary on your part or without attribution should be avoided.

I'd be surprised if anyone on IE dislikes Panda. His avatars have universal appeal. Why, it'd be downright unAmerican to dislike boobs.
