Aaron Hernandez charged with murder

So, this case finally wrapped up and the jury is deliberating right now. I read a lot of conflicting things as to which side made the better argument. From the start, I thought he would get off (although I believe he is guilty) due to the fact that there is no weapon and no motive.

Hernandez has a good team of lawyers. I'll link an article below, but it seems like they made the better closing argument today than the State did.

It's been a very odd trial all around. A bomb threat took place, Robert Kraft took the stand, as did Hernandez's girlfriend....so did a guy who was shot in the eye by Hernandez in a separate incident. A PCP "expert" was brought in, and, finally, the Hernandez defense team today admitted that Aaron was at the scene of the murder but that he did not commit the murder himself. Could be a genius move by them to throw that admission out there so late.

I don't think they were admitting anything that evidence didn't already show. His cell phone triangulation put him there as did his and the deceased's DNA on a joint roach found at scene of crime.

However, theres no evidence showing who pulled the trigger. But if they cant prove which one did it doesn't the court usually decide to punish all involved?

Admitting he was there? Probably a bad move, unless as stated they believe the jury may be leaning against him. Hope he rots.

I knew a guy in high school who was a PCP "expert". He said that he wrote the secrets of the universe on a napkin.

As NDd2 pointed out, they knew he was there. DNA on the joint at scene, bullet casing matching the bullet in victim from the weapon in his car, etc.etc. The one thing they can't prove is who pulled the trigger but people have been convicted of murder before w similar or less circumstantial evidence. I too hope this bastard rots, he deserves it.

I'm always amazed at how some people who grow up in difficult circumstances and surrounded by crime make the most of their chance as a pro athlete to escape that past, while others, no matter how much money and opportunity, can't let it go and better themselves.

I have a bad feeling about this. Doesn't it take like just one person to say no and the dude walks? He's a bad egg...IMO.

If you are in a state like Indiana, yes (see The Elkhart 4), but he wasn't in Indiana.


Hey law nerds, somebody help me out. Is "motive" something that has to proven in court? For some reason I'm having flashbacks of college law classes and I believe that in most scenarios it does not. Kind of one of those things they talk about in cop shows that really doesn't translate to real life. Am I recalling correctly?

It depends on the crime. Mens rea is an element of murder, so the prosecution has to prove the bad intentions of the defendant in order to secure a conviction. If the prosecution can prove the defendant did the deed, but they've got no clue why, their case is not strong.

Expected to get life in prison without the possibility of parole. That'll be announced in 20 minutes or so according to ESPN.

Can't get the death penalty in Massachusetts.

He'll get nailed for the double-murder next, as there is an eye witness who was with Hernandez at the time and witnessed the shooting and is very willing to testify against him considering Hernandez later shot him in the eye as well in a different incident (Aaron was really a great guy).

Nope. Not for a state-charged crime. Terrorist #2 has a federal crime, and he might avoid it also as most of the state's citizens are against the death penalty in general.

Those Florida teams were filled with some questionable guys. Hernandez, Harvin, Cooper, Pouncey twins, Spikes...then Tebow somehow surrounded by those idiots....I'm sure many more oddballs on the team as well.
