In my experience, 12 years Sheriff's Dept, 18 years Superior Court clerk in California, DA has 72 hours, on court days, in which to file charges or the defendant is released. When the DA does finally file the complaint, the charges often bear very little resemblance to what the police originally charged.

Police go heavy on original charges, then let the DA sort it out, quite often dropping felonies to misdemeanors. I am guessing Butler will be tried on misdemeanors, if tried at all.

But poor judgment and unfavorable notoriety likely mean that he is done with football.

I thin he's absolutely gone. He assaulted a woman and a cop. Why would you still want this POS on the team?

Sorry I guess I jumped to conclusions. I'll wait to see what he's actually charged with. I was basing my opinion off one of the articles which may or may not have been accurate. Hopefully the first hand account Bogs posted is what really happened.

If he is formally charged, based on eyewitnesses, Butler should request a jury trial and call all of those witnesses to testify. No plea bargain.

Turns out the cop, whose account already stunk based on some first hand accounts from witnesses,has a history of BS police reports and civil rights violations. Soooooo... yeah. Doubt this goes to trial, but if it did I bet Butler wins.

Not only that, Butler may have won the lottery.

I mean some people go to college to play football, and after four years get rich, but this may be a bit of a different angle on all that.

If South Bend still employed a cop who lied on reports, and almost beat citizens to death, and it is true that no witness statements were taken in this case before the police officer preferred charges, there is a massive liability here.

Not only would the department be guilty of allowing a compromised officer on the street, but apparently nobody checked on his claims before his affidavit worked its way through the system.

That, (if true) is a really, really, really, bad thing.

I don't care about all the issues the cop had in the past...come on guys. I think you guys are reaching.

Devin Butler shouldn't be involved in altercations with cops. And he should never put his hands on an officer..I don't care if he's breaking up a fight. That's a foolish argument.

He should be sitting with Redfield after this.

So if the DA drops all accusations against Butler and does not go forward with pressing charges, do you think Butler will be immediately reinstated to the team? Or will he still face some kind of internal punishment.

Hahahahaha. Damnit, I really didn't want anyone to find out about this. No the only reason I asked is because ND seems to hold its football players to a different standard than most other major college football programs. I'm not saying that is a bad thing, but I live in SEC country where players with guns, marijuana, and fighting with police is pretty much no big deal.

I would suspend him for a game even if he is not charged. He still put himself in a situation that brought embarrassment and negative publicity to the team and deserves to be punished in some way. Ideally he would be suspended for Nevada and not Texas but that would be difficult to justify.

Edit: I would suspend him for one half of the Texas game. Not the full game.

One thing I've learned A LONG time ago is that we cannot jump to conclusions until ALL the facts are on the table. That being said, I think D. Butler will face some sort of internal punishment. That's just my humble opinion. The punishment may not be devastating but a punishment non-the less.

This is an incredibly silly post. The problem isn't that he has a past of excessive force, civil rights violations, and questionable police reports to justify these actions... the problem is that he has that past and his story doesn't add up with a lot of first hand witness accounts and some common sense.

So, I feel this was an issue of poor policing, which I believe is truly the exception.

At the same time, Devin still has culpability. As much as I believe the policeman didn't do his job correctly, and probably escalated the situation, I believe Devin has culpability and should pay the price.

Fist of thank you Boggs. Second I have been involved in the situation you just wrote about. I have watched police officers just run into a crowd and start grabbing people with no announcement of who they are. Always, always announce yourself as law enforcement. Otherwise that officer is just another ass in the fight. Now I wasn't there I don't know how it went do, but always announce yourself, and if the person you put your hands on continues to fight well then it's on them, not the officer.

First, you are just assuming, based on "eyewitnesses" that he did nothing wrong but break up a fight. Would you like me to go into how credible and reliable a bunch of intoxicated college kids are? Oh, and I bet they aren't bias at all against police.....

You claim common sense...yet you believe some cops just walked up and assaulted him for trying to break up a fight. I'm saying that Butler was likely a bit tipsey and agitated leaving the bar and seeing his girl fighting, and when a cop put his hands on him to move him out of the way, he shoved the cop and got into it with him.

Now tell me what sounds more like common sense?


Also he wasn't the only cop there. As much as you want to link everything together to discredit this guy, I bet I could dig up dirt on Butler and label him in the same manner. Also, should we go ahead and label Williams, Coney, and the other two while we're at it...Pot smoking idiots who shouldn't be trusted from now on?



Look, maybe he doesn't get charged...and then Kelly can do whatever he feels is necessary...but you can bet that if this was some kid on Stanford, we'd be blowing him up about it.

I feel that we should cut ties and move on from Butler. I've seen the term "ND men" more than once on my short time here and Butler is clearly not a good representation of that term

We assume they didn't announce themselves.

And I don't know many cops that allow for the "well, I didn't know you were a cop when I put my hands on you" defense. That don't fly.

And I have two uncles that are officers (both over 20yrs on the force) and my best friend is a cop in Austin just for reference sake.


Also, we are more than likely dealing with a buncha college kids that are drunk/have been drinking. That is absolutely a factor.

There are three distinct elements that make up what you're describing. First, Notre Dame holds all of its students to a different standard than the average state university. Second, Notre Dame doesn't compromise those standards when it comes to football players. Third, state schools tend to have cozy relationships with state and local PDs that doesn't exist between Notre Dame and ISP. NDSP is a different story.

Asking those who have been to The Backer before. Have you guys ever seen something like this ever happen before? Hearing this surprised me because every time I have been there it has been filled with grown ass adults and somewhat nerdy college kids. I wouldn't think this kind of crowd would be there.

By "this kind of crowd" I assume you mean football players. If so, I would tend to agree with you. Whenever I have been there it is mostly older people and nerds who don't drink at house parties/want to dance to Miley Cyrus.

That could've been their last stop...

Mellow bars can turn quickly if you get a group that walks in already wasted.

Seen that happen too many times while I bartended in school
