I did a couple quick searches to see if I could find anything posted here, I didn't find anything so apologies if I didn't look in the right place...

But... WTF.

Timeline of Case:

Brock Turner's Stanford Rape Case: Everything You Need to Know - Us Weekly

Fuck this turd, Fuck this judge and double fuck the dad and the longtime friend.

If you don't want to read basically this turd was raping this girl behind a dumpster at a frat party. She was, of course, unconcious. He is/was a swimmer on the Stanford swim team. 2 guys caught him and held him for police.

Long story short, out of a 10 year max sentence he got 6 months, possibly 3 with good behaviour. The dad penned a letter to the judge signifying that "20 minutes of action" on his kids part isn't worth the "lifetime of work" he has put in to achieve his goal.

The judge basically agreed and said a harsh sentence would have a severe impact on the rapist. And that he wouldn't hurt others.

Courts/Judges are obviously biased when it comes to swimmers. First Michael Phelps get caught smoking out of a bong, no jail time. Now they're practically getting away with rape.

Smoking out of a bong? i hope you're kidding. Phelps, or anyone who decides to smoke pot, doesn't deserve jail time. That's a ridiculous comparison. Rape and pot smoking....I'm new to this site so forgive me if I didn't see something here of sarcasm.

Lol I said literaly the same thing on another site... "Is shooting someone better than kicking them twice because it takes less time? Wtf does the duration of the rape have to do with anything?"

This case is super fucked. On one hand, he allegedly (I don't know if this is true but it's what I read somewhere) didn't actually put his junk in her and it was really ambiguous what acts he performed because she was unconscious and the witness interrupted him. So I guess it was hard to get him on a serious charge like "aggravated rape" that would've carried a longer minimum sentence.

On the other hand, that judge is a fool and screwed up royally with his statements more than anything. The statements from the victim were POWERFUL and then he lets him off light as can be?

Criminal defense attorney here -

I won't comment on the sentence or the judge's reasoning because, well, it's all out there in the media for all to see and I don't know California sentencing law. Truthfully, I actually don't know that much about the case aside from what was in the victim's letter.

That being said, when I saw some of the snippets from this guy's dad's letter, even I was appalled. If it is true that the defendant in this case went and hired high powered legal counsel then I'm completely at a loss as to why this letter was not intercepted by the attorneys and made to be redone. It's one thing for the attorneys to paint a victim as being a liar, unchaste, or whatever as a part of defense strategy. That's the job they legally and ethically have to do for their clients, however, allowing that to continue into sentencing is crazy in my opinion! What's the benefit?

Pretty sure that father's stance would be different if it was HIS daughter being assaulted for "just 20 minutes". In what universe does a man only get six months (three with good behavior) for doing that? That judge should serve the rest of his sentence.

How she get behind a dumpster? How did 2 guys see/know she was unconscious and being raped? Wouldn't they have to walk right up to 2 people having sex, see her face and notice she's out of it then ask the guy yo does she know your inside her. Ops link didn't have that unless I missed it, also they removed the unconscious and intoxicated rape charge? Isn't that the whole purpose of what happened?

The dude was found guilty on three major counts, and he's getting six months? Because he's a good kid? GOOD KIDS DON'T RAPE PEOPLE.

Someone needs to visit this fuckhead, his fuckhead father, and the fuckhead judge. Unbelievable.

Aggravated rape doesn't mean that it has to involve the rapists using their dick. Aggravated rape is unlawful sexual penetration of a victim by the defendant or the defendant by a victim accompanied by any of the following circumstances:

(1) Force or coercion is used to accomplish the act and the defendant is armed with a weapon or any article used or fashioned in a manner to lead the victim reasonably to believe it to be a weapon;
(2) The defendant causes bodily injury to the victim;
(3) The defendant is aided or abetted by one (1) or more other persons; and
(A) Force or coercion is used to accomplish the act; or
(B) The defendant knows or has reason to know that the victim is mentally defective, mentally incapacitated or physically helpless.

I bolded the pertinent elements in this case. Regardless, I think one piece that is going unspoken is that the judge literally broke rule of law. He made specific exception to the ruling made by the jury. There is a distinct punishment window for the crimes the jury found him guilty of, but he circumvented that and created his own sentence. I hope the efforts to get him impeached and removed from the bench work.

Why is rape the worst crime you can commit, short of murder? I'm not saying we should be less outraged about rape, but why aren't we more outraged about things like domestic abuse? Is a man beats the shit out of his wife "less bad" than a rapist simply because there were no genitals involved? The sentencing guidelines for the two crimes are vastly different.

FWIW, I agree with the idea that rape is more egregious than domestic battery, but I don't think I could articulate why.

My immediate reaction is to say that the psychological effects of sexual assault are much greater than the effects of other transgressions. It is the forceful taking of something that we are taught from the very beginning to cherish, value and protect.

We are raised knowing that we may, at some point, find ourselves in a physical altercation. So while a wife being beaten by her husband absolutely, 100% results in psychological damage, it is a damage that is recognized, if even just subconsciously, as a possibility in life as connected to other, more broad ideas of "physical altercation"... whereas sexual assault is something that we talk about, but I don't think people ever consider that it could actually happen to them, in any sense. That's why it is such an egregious act.

I agree it's hard to articulate. But I guess I would say rape encompasses abuse and goes even further. Woman suffer physical harm from rape and also the sexual aspect.

Furthermore, the domestic abuse you are referring to is perpetrated by someone they know and perhaps is not as emotional scarring. Rape by the classical definition is not going to be perpetrated by someone's husband-rather it might be a stranger.

There are some cool producers who are making a series called, "Making a Rapist". They'll be exploring how he was framed and include only the pertinent information that helps support their claim. Then really smart people will lambast you if you don't agree with them.

Rich white kid getting a deal is like affluenza kid in Texas. Wrong, sure.., but the media can feast on it. Just like that school shooting in Washington they quit covering once the kid was revealed to be not white.

Actually, my thought was I wonder if this kid will get "20 minutes" or more on the receiving end of the same thing he tried during his 3-6 months. If so, I don't see how the father should be upset by it.

Suggesting to college women that it would be unwise to be blackout drunk and alone passed out behind a dumpster is seen as "victim shaming." Feminists like to say that women should be able to wear whatever they want and behave however they want without worrying about being victims. Of course they should be able to do so, but evil people exist and they do evil things. I hope that the legitimate efforts to protect this victim don't inadvertently lead to a dishonest rhetorical environment in which we can't say what needs to be said to protect future victims.

I doubt it. He isn't even going to prison, he's going to jail. He'll be in with traffic violators and drunk tank peeps.

I once dated a girl who was previously raped. By someone she knew. This was 5 years after the fact and she still couldn't sleep through the night without reliving the event. Second by second I would watch her as she spoke every word that happened during the attack. All in her sleep.

Maybe, but I don't think the psychology of the victim matters as much as you would think. For example, in the specific case of Brock Turner, the victim says she didn't remember anything and wouldn't have even known she had been raped if she wasn't told about it after the fact. Separately, a teenager who has sex with his hot teacher and brags about it after the fact isn't going to be emotionally traumatized in the same way as the victim of a violent rape. If psychological damage to the victim were the driving factor, beating your wife would be "worse" than raping an unconscious person, and I think we all agree that's not the case. Like I said, I don't have the answer, I'm just trying to work through it intellectually.

That would be wonderful, but it's also childishly naive and Utopian. You can't teach a rapist not to rape. "Oh wow, I never realized how wrong rape was, so I'm not going to assault that drunk woman," said no potential rapist ever. I live in the real world, and the real world has bad people. It's an unfortunate reality that good people need to be prepared to protect themselves from bad people. I didn't do anything to deserve getting robbed, but I still lock my door at night. You didn't do anything to deserve to have your car stolen, but you presumably don't leave the keys in the ignition when you park on a public street.

Teaching women that they're invincible is ignorant and harms the women it purports to empower. Obviously the perfect society would not have sexual predators running around, but so long as we live in an imperfect society (read: forever), I'd rather women be given good information about how to protect themselves from those that would do them harm.

GTFO with that, seriously. I never said let the bros off the hook, and it's an outrage what's happening in California right now. Rapists deserve severe punishment. But punishing rape is not enough. We also need to dedicate time an energy to preventing rape.
