Yes. He's required under his contract to mitigate any damages. Basically, he has to be looking and interviewing for a job otherwise Texas doesn't have to pay him, per his contract.
- If he does land a job (say $1 mil/year), Texas pays him the difference between what he's owed under the contract and what his new job pays him. So $4 mil/year.
- If he lands a job that pays him more than $5 mil/year, Texas may not have to pay him anything. That's probably spelled out in the contract details.
- If he doesn't land a job, but puts in a good faith effort, Texas will pay him the full $5 mil/year.
- If he sits around like a bum, Texas won't have to pay him anything.
This is typically how contract law works. The party who didn't void the contract is usually responsible for mitigating or lessening the damages the breaching party has to pay. You're expected to always try to improve your situation if you get screwed.

Decision-makers understand how many of us feel, but have also made it clear they don't particularly care. Swarbrick laughed it off, which is fine, but we're going to laugh right back at him by publicly mocking Kelly (and Swarbrick's willingness to protect Kelly). The overton window is moving quickly.
How is this hurting recruiting, again? How does this influence the way a recruit perceives the program? Fans aren't saying anything about the program that Meyer, Harbaugh, etc., aren't saying. Would recruits rather go to a school where fans accept mediocrity?
Yes, getting upset that Swarbrick won't publicly throw the coach he is stuck with under the bus and thinking the appropriate response is to throw a tantrum makes you a petulant child.

"The coach he is stuck with" is a pretty misleading way of putting it, don't you think? He stuck himself (and everyone else) with this coach. I guess saying we need "accountability for failure" is trite at this point, but there is no other way to put it.
Not sure how much of an effect it will have beyond the effect of things already known: the other teams that we compete with for recruits are much better coached than ND; ND just had one of its worst seasons in the history of the program; many (most?) fans want Kelly gone.

No, it isn't, if you actually have knowledge about how everything played out during and after the season with the decision makers who give marching orders to Swarbrick.
If you don't think there is a difference between hearing neg recruiting from other schools... something that is dealt with every year in some form by every coach... and seeing what those schools are saying validated by dumbass snow messages and ads while on campus for a visit I don't know what to tell you.
When the primary sell to Greg Johnson is "don't go to ND... you don't know who your coach will be because BK is getting fired next year." And ND coaches say "nah, he has a 5 year deal and it's just one bad season and we'll bounce back. Look at what our AD said."... and then you get on campus and walking around to see snow for the first time see "FIRE KELLY" written by students and a newspaper ad in the local paper and so forth it validates the opposing coaches and makes it exceedingly hard to defeat the neg recruiting and uncertainty.
