Report: Michigan under investigation for response to 2009 rape case - CBSSports.com

The University of Michigan is reportedly the subject of a federal investigation regarding the school's handling of an alleged 2009 rape involving former kicker Brendan Gibbons.

The Detroit News reported Tuesday that two complaints prompted the investigation, and the U.S. Department of Eduction confirmed that the Office for Civil Rights is investigating a Title IX complaint involving the school.

Gibbons was arrested, but never charged, after it was alleged that he sexually assaulted a female student at a party on Nov. 22, 2009. It was not until Dec. 19, 2013 that Gibbons received a letter telling him he would be expelled from the school due to a violation of the Student Sexual Conduct Policy.

According to the report, Doug Smith, a former University of the Michigan pathologist, filed a complained with the U.S. Department of Education last year. He alleged that the school refused to investigate the case and claimed that "the grievance procedure does not fully comply with Title IX." Smith has reportedly been one of the "loudest voices demanding that the university investigate the alleged rape."

More details, via The Detroit News:

According to the letter sent to Smith: “(The Office for Civil Rights) has determined it is appropriate to proceed to investigation on the following issue: that the University failed to promptly and equitably respond to complaints, reports and/or incidents of sexual violence of which it had notice, and, as a result, students were subjected to a sexually hostile environment.”

The letter also indicated that one of the students was expelled from U-M in December 2013. That month, the university notified Gibbons that he was being expelled for violating the school's sexual misconduct policy.

University officials did not immediately respond to requests for comment on the investigation. The victim, and Gibbons, also could not be reached for comment.

Brady Hoke released a statement earlier this month regarding the strange timeline of events in the Gibbons case. He denied any influence from the athletic department, but declined to share any details due to federal privacy laws and University policies.

"Michigan Athletics has no influence over any part of a review of a potential violation of University's student code of conduct — not the process, the investigation or the timing of the resolution," Hoke said. "In general, while we may be aware of an ongoing proceeding, we always strive to balance transparency with privacy.

"Our usual approach is to not issue discipline related to a student's standing on the team before the University's process runs its course and the outcome has been determined. We will always respect the rights and confidentiality of the process and the parties involved. One way we do that is by not discussing the details of student disciplinary matters."

Taylor Lewan, Gibbons' former roommate, addressed the issue last week at the NFL Combine.

"That's definitely a situation between those two people," Lewan told MLive.com in Indianapolis, in response to allegations that he intimidated the witness in the Gibbons case. "I'm not here to protect Brendan or the young lady. That's not what I'm here to do. I'm here to talk about football."

According to The Detroit News, a group of Michigan students are planning to march to the Fleming Administration Building to demonstrate against the administration's handling of sexual violence cases.

I'm pretty sure he was expelled after he graduated. Can someone verify that?

That's my understanding as well. If he already has a diploma from UM, it's basically meaningless. Like a former boss announcing you've been fired weeks after you quit. Just a hollow attempt by UM to publicly censure Gibbons for PR reasons.

But I try not to assume the worst, especially regarding my enemies. Maybe they're withholding Gibbons' degree/ refusing to certify him as a graduate? That would at least mean something. I doubt it though.

Im pretty sure he finished undergrad and received his diploma.

He then enrolled in a graduate program, played football last fall, and then got kicked out of the graduate program during the month of November.

Can't find the link, but they are on the MSU campus also. But it said it was the student side not the athletics. However, it did last Payne and Appling among those in the list of previously accused.

If the timeline is correct, I don't think they could do that. I think it would be after the fact. I mean I guess they could maybe actually refrain from sending him an actual piece of paper, but if he's completed all the requirements and met all their standards, then I don't think they can then say he's not a graduate. So I'm with you in the doubt.

Yes, I assume he got an undergrad degree from um (one would think he had to do this to begin a graduate program, but there are a few exceptions). I was thinking he had finished grad school too, but maybe he was only in for a semester?

If he were receiving a MS in Rape, then I believe he graduated Summa Cum Laude already.

Gibbons did in fact get his degree and he was enrolled in the SSW for the fall semester. His undergrad degree is already in hand, so there is no revoking that.

Are you serious? Because Lewan only breaks up conflicts. He doesn't create them by threatening to rape a rape victim or pulling a defenseless player's facemask when on the bottom of a pile. You act like he's a total POS.

It would be funny if someone went over his undergraduate record and found that he didn't have the credits to actually graduate, wouldn't it?

I have a professor friend, who has been involved through professional, teaching organizations, committees, and in other ways with a broad spectrum of professors from other schools, and from two sources, one a tenured professor, and another a large contributing alumnus, that Michigan, "did nothing less that commit fraud" to cover this up.

Between the two my friend feels that Hoke is safe from backlash over this. But the Hoke love from the past is over, and he has been given a clear directive of what is expected of him this year. Many feel that the only way to turn the program is to clean house after this year.

The emphasis is cleaning house. Specific powers are interested in heads rolling in the athletic department. News that Mary is dead begs the timing of events.

When incoming University of Michigan president Mark Schlissel first experienced Ann Arbor, it was during a clandestine tour that, oddly enough, made a stop at perhaps the most famous business in Ann Arbor: Zingerman's Deli.

Yet, luckily for Schlissel and unluckily for the media hoping to scoop the veiled presidential search process, he went undiscovered.

It was a cold winter Saturday, and Schlissel was secretly interviewing for the top spot at U-M. Regents, considering him a top candidate, invited him to Ann Arbor to experience the town, but they knew they had to make sure Schlissel — Brown University's provost and a well-known biomedical researcher — went unnoticed.

"Surprisingly, even though I'd given seminars at dozens of universities around the country about my own research, I'd never been invited to give a talk at Michigan, so I'd never been on the campus before," Schlissel recalled.

U-M's Board of Regents on Friday voted unanimously to elect Schlissel as U-M's 14th president. He begins in July.
