Best explanation : remember mental illness and defect makes a victim unaware, and forcible can mean as little as intentionally fondling.

I'm a lawyer---just didn't want to sound like a prick when I questioned the post.

Sexual battery and rape are very different because of the intercourse aspect.

I assumed that. Speaking of asses, I will be one I couldn't resist, "So, then what we don't get the benefit of your on the job performance because you don't have anyone to bill?"

I am kidding.

So I made a point earlier repeating what and Indiana atty told me. He basically thought the reason that ND player was investigated in the first place was because of her history of mental illness. That would be enough to negate her ability to consent. True?

I long for the day when Lizzy Seeberg isn't brought up relative to every sexual assault case on every college campus. What's more tragic than many cases is that Seeberg took her life. What's borderline mundane is what actually happened even if literally everything she said happened.

Lost in all of the media outrage is that even if everything she said was 100% accurate (which would be impossible considering her two statements had discrepancies with each other, and cell phone record conclusively proved certain parts of her statements to be false) the accused would be at worst looking at a class D felony and probably zero jail time. More likely than not, going by Seeberg's statements that he stopped of his own volition and that she "froze" instead of vigorously protesting, he wouldn't be convicted of anything... or even indicted in the first place.

Relative to Brendan Gibbons, you're talking about a felony with upwards of 20 years in jail. And you're talking about felony witness intimidation and other charges for Lewan. What was covered up by Michigan is on a completely different level than the alleged "crime" at ND.

But the story with ND was much juicier for obvious reasons, so the media ran with it for hits. That's the society we live in.

I absolutely loathe everything Michigan.......I can honestly say there isn't an institution out there for higher learning that I fucking dislike more......I remember reading Gibbons story a year or two ago when it was first posted on one of the ND sites. Nothing became of it so I just figured nothing was ever going to be done......I hope that shit hole in Ann Arbor burns to the fucking ground!!!!

Fuck Michigan.......

Just a note, they weren't barred. They weren't informed. Which is big University's way of saying "go pound salt". Happens all the time.

Fucking Michigan scumbags… I wonder what their excuse for this is?

- Didn't kick him out from the start because of bad policy.
- Didn't do anything for the next couple years because RichRod wasn't paying attention.
- Brady Hoke didn't know because it happened before his time.
- Didn't punish Lewan because their new policy doesn't allow them.
- No proof on Lewan, only the one side's story.
- Hoke didn't know if he could say anything about Gibbons, that's why he said he was missing the bowl game for "family reasons". He wasn't protecting Gibbons, just the school.
- Just a coincidence they waited until Super Bowl week to announce it.

So many coincidences!! There has to be a good reason the student press was barred from a media session. They were probably just at max capacity for the room per the fire marshall...

Yeah. My house is now over 100 years old (a tad older than me) and hasn't burned to the ground yet. So why do my insurance premiums go up every year?

I don't know how much effect it can have. I think all the stuff they will try to get will still be covered by FERPA. But it's a political statement, and a loud one. Keep in mind the Daily will back them on this. The Daily has catapulted lots of journalists careers (Schefter, Deitsch, Auerbach, etc.). Should create enough pressure for lame duck President Coleman to do more than spit out nonsense in a press release.

I find it difficult to believe anything posted on "twit" dot anything.

Should this be real, I applaud and encourage the effort.

I doubt, though, that it will result in anything more than mealy-mouthed back pedaling and cover its ass maneuvers by the administration and heads of the football program.

Does that mean they are taking Devin's Heisman number "98" away? Bawhahaha!

Giving Gardner 98 was so stupid, it just didn't look right at all. I'm sure by the end of the season Mark Harmon was saying "Uhhh...lets just leave that number retired from now on."

I was so fired up when I saw him come out of the tunnel in 98. Microcosm of scUM. Total douche move. Pure Michigan indeed.
