Therein lies the problem: I see your point, but now everyone will be rushing to judgement on the former case, concluding it was worse than reported. It very well may have been, but this incident doesn't prove that.

Oh I know it doesn't prove anything but I'd be lying if I said it didn't put a little doubt in my head.

That's the elephant in the room, isn't it? How do you view the situation now given this and what happened with him in high school?

I don't know if anyone ever really believed "his version", per se. But as the DA said when not pursuing charges... her version(s) did not match with physical evidence. Specifically, the events as she laid them out in her final statement could not have occurred... because for Shembo to stop mid assault to answer his phone would've required a phone call be received during the time in question. And phone records conclusively proved that he never received any communication then.

Her account literally states something along the lines of he starts kissing her, then starts feeling her breasts which is when she gets fearful/uncomfortable, and then as that is happening his phone starts ringing... he then pushes her off of him to go answer the phone... and that's the end. None of us will ever know exactly what happened there, but we do know:
1. That never happened, because he never got up and answered a phone call, period.
2. That the rape kit returned no physical evidence where there could or should have been some per her account(s).
3. As much as ND haters will scream otherwise, there was never an accusation of rape and no sex occurred... period.

Given those facts I'm comfortable with him not getting thrown out of the University or prosecuted at the time.

HOWEVER... it also seems reasonable to conclude that even if her accounts(s) weren't accurate something bad still might've happened. He might've gotten pushy or forceful, who knows. We'll never really know. He's clearly now established a pattern of behavior that does not exemplify emotional control.* Moral of the story? ND would've been much better off from a PR standpoint doing a "Duke" and throwing Shembo under the bus regardless of evidence. From now until the end of time people will second guess their handling of him.

*Of course, assuming the allegations with the dog are true.

The biggest thing that makes me wonder about his incident at ND is the way he was almost taunting the girl about her dog... What kind of place is this guy at mentally in regards to females and their treatment?

The vast majority of football players already come in with a lower academic standard. You can't field a team with kids at the top of their class and expect to be a top 10 team. That would turn Notre Dame into Harvard.

I will say that I mostly believe his Seeberg story, but mainly because of some mutual acquaintances that may have skewed my opinion. In terms of the bolded, we're talking about a man who makes his living beating people up to make his way to another man that he hopes to drive into the ground ASAP (all in the legal realms of the sport). I'm a dog lover and a sports fan, but I don't understand the surprise when football players display violence. We should condemn and prosecute it, but this didn't really surprise me.

I'm going to respectfully disagree with you on some of this. Making your living in a violent, but legal way is probably not the cause of violent behavior in your personal life. There are countless boxers, professional football players, and members of the military who've seen extensive combat and killed frequently, but clearly know where the line is between their job and the rest of their lives. In fact I believe the vast majority fall into that category. I'm inclined to believe the athletes in violent sports who act like assholes and beat their wives, murder their business associates, and kill their pets are more a product of entitlement and never having had boundaries set or having to be responsible for their behavior instead of carrying the violence of their job home.
