I have been looking for pictures of the Focus to see if it was a hatchback. If it was, and the gun was in the hatch area, none of the occupants may have known of it. But as a law enforcement officer explained, the wingspan rule is used. Anyone within reach, or anyone within throwing distance, can be charged. This would explain why the three in the back seat were charged and the two in the front weren't.
It is particularly critical that the driver wasn't charged with anything gun related, because he was in control of the vehicle. Which makes me wonder if anyone knows yet whose Focus it was. Apparently sources agree that Ashton White was driving.

We know that he wasn't arrested for being in possession of an unlicensed handgun. Because licensed or unlicensed is irrelevant. It was transportation that was the misdemeanor charge, i.e., one in the chamber.
