With the Rittenhouse trial a lot of pundits have thought the prosecution may have basically botched the case from the start. Some have said that the defense could probably not even call their witnesses at this point because the prosecutor is basically trying to get witnesses to refute stories that contradict video evidence. Maybe they knew from the start that it was an unwinnable case for the state, but public outcry forced their hand to go to trial. The idea is that the only way plausible way Rittenhouse is found guilty on any counts is if the jury is pressured or worried about blow back through rioting and attacks by protesters.

I think the reporter's testimony sealed the case. Interesting to see if they call him to the stand. I don't think they need to because of the amount of video available. It is interesting that the FBI held onto the video they had.

I have next to no experience or classes in the criminal stuff, but the optics so far have screamed "self defense." I feel bad for the prosecutor. Dudes been getting nuked on national television.

The excuse story is already half written. It will be blamed on a defense attorney who discriminated against blacks as part of the jury selection process. I predict another wave of riots.

Just like jury tampering or any other effort to unlawfully affect a trial's proceedings and outcome, that needs to be a MAJOR felony. No pleas, no leniency, no suspended sentence. You start trying to threaten, intimidate, and doxx court officials and jurors, you go to prison for a long time. Period. This is like some third world BS where they kill DA's and judges who prosecute drug lords or crime bosses.

Rumors swirling that the BOTH sides are shooting for a mistrial. Just a difference of whether it would be with or without prejudice.
I listened to most of today. I was shocked they put the kid on the stand. I figured they already had a layup. He did fine, tripped up a few times.
I have only spent a summer in a courtroom, mostly little things. But a few trials. My judge lectured the prosecutor once or twice...but he never nuked a guy the way this dude did.
Prosecutor is not likable and straight up sounds dumb half the time. Kid is an idiot. Shouldnt have been there...but he was. He should walk.

The entire trial is bizarre. There is quite obvious bias/malice on multiple sides. The judge dismissing the charge of him being out past curfew for "lack of evidence" is absurd when there are multiple videos and eye witness accounts that clearly put him out past curfew and all were brought in as evidence. The prosecutor likewise did some absurd things. I'm no lawyer but I've never, ever seen or heard of a judge just start screaming at someone in open court even when they do something egregious.
Trending towards either a mistrial or him getting convicted on the gun charge (should be black and white -- he was 17 and was illegally possesing a firearm)... fairly certain the judge is not going to give him 9 months on that though, likely will give him zero the way he is administering this trial.
It was a nice touch that the judge's ringtone is the same song Trump plays when he takes the stage for rallies. I don't care if that means anything or not, it's bad optics and what kind of grown ass man has a ringtone these days.

Yeah, I'm guessing he is ruing the day he decided to go. Defense could very well get a mistrial. Not sure why the prosecution would be granted one given it's them overstepping the boundaries. If the defense gets a mistrial, I wouldn't be surprised to see the prosecution go lick their wounds and not refile.

The state presented no evidence of a lawful curfew order and it was dismissed accordingly. It wasn't a lack of evidence that he violated the curfew, but rather a lack of evidence that the curfew was in place.
I think the prosecutor knows he has presented no case and everything points towards Kyle being justified in all of his actions. The only part that was bizarre to me was the cross-examination from Binger to Rittenhouse. The whole thing felt like him trying to scratch every angle looking for Kyle to break down and open up some angle or get a quotable admission. Demonstrating that he used deadly force to stop an attack, that he carried a weapon for the intent of defending himself and equating that to intent to use it, the video games angle, and the lack of remorse thing was all just reaching for something. I'm not sure why someone who was a victim of multiple attacks and if suffering from that still should be expected to demonstrate remorse. Especially, after being labeled a white supremacist by our POTUS and smeared by the media and members of Congress.
Anything less than Kyle walking free with less than an hour of deliberation is just wrong. The media won't fess up to lying and smearing him over who he is so the backlash will likely be strong. Look for more of the white-supremacy-racism narrative from the loons.

If this were a muddier case, the judge's conduct might be eyebrow-raising... the guy sounds like a public defender rather than a judge lol. I don't know enough about court proceedings to know if it's justified or not, but it is interesting to see from the outside.

I think some people are upset because of his "Trumpian Ringtone" or blasting the Prosecutor for crossing the line on cross-examination. He was appointed by a Dem and has held the trial in order fine from what I've seen.
He dismissed the jury every time he started bitching out the ADA. The ADA actually committed an egregious error when he questioned Kyle on his silence since being charged. He also brought up things that were ruled in admissible during pre trial hearings which is a huge no no. A first year law student wouldnt fuck up that bad.

Like someone already mentioned, the prosecution simply didn't prosecute the charge, at least that is my understanding (haven't watched the entire trial to know if this is absolutely true). If it is true, the charge was properly dismissed by the judge. This isn't uncommon. From what I have watched, the prosecutor was having a difficult time getting the testimony he wanted to prove the murder charges so they may have strategically decided to avoid prosecuting the charge so they could focus their attention on the murder and gun charges. There is no point in dicking around with the gun charge if you can convince the jury he's a murderer. Less is more sometimes.
It happens. It's best that it doens't and it's not a good look but happens. What really stuck out to me is when the Judge said "Don't get brazen with me". That comment was not solely due to the argument he made as to why he believed he would be able to use evidence that he was strictly prohibited from using. In my opinion, it was a combination of the following that the judge believed to be brazen conduct:
First, the police did not execute a search warrant on one of DA's witness's phone. This was probably lost on the jury, and perhaps it was lost on most people watching. It was not lost on the judge. You can bet your ass that had nothing to do with the police department and everything to do with the district attorney. They didn't want that phone b/c they knew the evidence on that phone would likely hurt their case more than it would help. The DA has a duty to disclose exculpatory evidence, which that phone could have contained, so they just told the police to ignore the court order. There is no other reasonable explanation. Dirty move, and the judge knew it.
Second, it seems very possible that the prosecutor was trying to coerce the photographer into changing his statement. He seemed very credible. On cross examination, the prosecutor beat the living shit out of him and the judge was more than likely disgusted by the behavior - both the possible coercion and the cross examination. In my opinion, the DA's office did this purposely even though they knew it could/would likely hurt their chances in this case, and the defense didn't object to the line of questioning to protect their witness b/c they knew it looked bad in front of the jury. It got so bad at one point that the judge stopped them without an objection. So you have a guy here that was a witness to a tragic event who willingly provided a statement to three different branches, the FBI, ATF and local police, and the thanks he got was being absolutely abused by the state on the witness stand. The aggresive cross examination had little to do with prosecuting the defendant and more to do with getting him to talk more and more so the DA can conjure up a bullshit perjury charge against him. It was disgusting, and the judge probably agrees. Don't talk to cops. That's the lesson here.
Third, the prosecutor earned every bit of that ass chewing. He intentially disgregarded the judge's order and asked the defendant why he excercised his right to silence in front of a jury knowing full well that is grounds for a mistrial - tax payer money spent on prosecuting the case and the jury's time be damned.
The DA's behavior is brazen. I would have preferred the judge kept his cool but everyone's patience has its limits.
The Judge dismissed a juror that made a joke about a shooting. It wasn't mandatory to my knowledge so he excercised his discretion in dismissing the juror. That lone juror would have been a problem for the prosecution. If this judge was hell bent on getting a verdict in favor of the defendant, keeping that juror on would have been a great way to do it. Does that mean the judge doesn't have his own opinons on the case? No, I'm not that naive. It does suggest he isn't one sided as the media is making him out to be.
I love our media - "oh my god, this judge doesn't agree with my hyperpartisan political opinions! He's not fair!"

Yeah, like I said, I'm not a lawyer but if I was on that jury there is no chance I'd convict on anything but the gun charge.
The weirder thing -- to me -- appears to be the circus surrounding the trial by the adults. The prosecutor is a clown show. The judge seems occasionally off his rocker. The juror making a joke about someone getting shot... while serving on a trial about three other people getting shot... is insane. Maybe he was intentionally trying to get thrown off the jury. But it's shocking to see the lack of professionalism across the board.
