Blasted by Trump and her own party, and praised by others, Murkowski takes independent course again in Kavanaugh vote (Anchorage Daily News)

Applauded by many but derided by President Donald Trump and her own Republican Party, Sen. Lisa Murkowski said Saturday her opposition to Brett Kavanaugh's appointment to the U.S. Supreme Court was driven by the facts at hand, not possible political retaliation.

"As a senator I've got one obligation here," Murkowski, R-Alaska, said in an interview with Alaska reporters Saturday. "I have to do the work that I believe is necessary in order to inform my decision, weigh and evaluate and use the best judgment I can and ultimately vote my conscience. I expect every one of my colleagues to do the same."

Trump, in a phone interview with The Washington Post on Saturday, said Murkowski will not survive re-election in 2022 because of outrage in Alaska over her opposition to Kavanaugh.

"I think she will never recover from this," Trump said. "I think the people from Alaska will never forgive her for what she did."


Alaska's other senator, Republican Dan Sullivan, voted to confirm Kavanaugh.

The head of Alaska's Republican Party said a significant response to Murkowski's opposition was required. Party members deeply supported Kavanaugh, he said.

"I am both shocked and disappointed," said GOP Chairman Tuckerman Babcock. "This vote (by Murkowski) is something that will stand and linger and mark a point in time."

On Friday, former Alaska Gov. Sarah Palin tweeted "Hey @LisaMurkowski – I can see 2022 from my house…," prompting speculation Palin might take Murkowski on in her next re-election battle.

But others rose to Murkowski's defense, saying she has strengthened her support among a broad group of Alaskans.

"There are are lot of progressive woman that vote for Sen. Murkowski, though she's a Republican, because we understand she doesn't always follow party lines and takes a critical look at each issue independently," said Kim Jones, an Anchorage resident who traveled to the capital this week and personally urged Murkowski to reject Kavanaugh.

"If she had voted yes then I think she would have lost a lot of supporters," Jones said.

The Senate on Saturday voted 50-48 to confirm Kavanaugh to the court. The decision is expected to push the court in a more conservative direction. The confirmation became especially controversial in recent weeks after three women brought decades-old sexual misconduct allegations against Kavanaugh, which he strenuously denied.

'Gut-wrenching'

Sullivan voted for Kavanaugh. In a floor speech Saturday, Sullivan noted his own efforts working to combat sexual assault and domestic violence as a former Alaska attorney general.


Like Murkowski, Sullivan called the process leading to the decision "gut-wrenching."

Kavanaugh's primary accuser, Christine Blasey Ford, was courageous for coming forward, Sullivan said. But a thorough FBI investigation could not corroborate Ford's claims against Kavanaugh, he said.

"At the same time, I do not agree with some of the comments made on the floor that a vote in favor of Judge Kavanaugh is somehow condoning sexual assault or not believing survivors," Sullivan said.

"This is not a Republican versus Democratic issue: This is an American epidemic and frankly, it's an American male issue. The men are the ones who are committing the vast majority of the abuse, and we need the country united to stop it," Sullivan said. He mentioned "my very good friend" Murkowski, saying "I very much appreciate her friendship. Like so many, this process has been difficult for her."

He said a lengthy meeting with Kavanaugh, and a thorough examination of his record convinced him he was a solid choice.

"He understands the importance of separations of powers and federalism, holds a healthy skepticism regarding the expansive power of federal agencies, and that he is a strong protector of the Second Amendment — all issues that Alaskans care deeply about," Sullivan said.

Murkowski gave a floor speech after voting against Kavanaugh during a procedural vote on Friday. She said the judge's temperament, underscored by sometimes sharp exchanges with questioners last week as he denied accusations of sexual misconduct, did not befit a nominee seeking a lifetime appointment to the highest court in the land.

As many people lose faith in the executive branch — including the Trump and Obama administrations — and lose faith in Congress, the judiciary must be held to the highest standards, Murkowski said.

"And even in the face of the worst thing that could happen, a sexual assault allegation; even in the face of an overly and overtly political process, a politicized process; even when one side of this chamber is absolutely dead set on defeating his nomination, from the very get-go, before he was even named; even in these situations, the standard is that a judge must 'act at all times in a manner that promotes public confidence. …'

"After the hearing that we all watched last week, last Thursday, it became clear to me, or it was becoming clearer that that appearance of impropriety has become unavoidable. … I am reminded there are only nine seats on the bench of the highest court in the land and these seats are occupied by these men and women for their lifetime and so those who seek one of these seats must meet the highest standard in all respects at all times and that is hard."

Murkowski voted "present" Saturday as a courtesy to Republican Kavanaugh supporter Steve Daines, who was to walk his daughter down the aisle at her wedding in Montana. That balanced out the absence without affecting the outcome, and gave Kavanaugh the same two-vote margin he'd have received had both lawmakers voted.

'Pretty uniformly negative'

Murkowski's rejection of Kavanaugh has enraged Republicans, said Tuckerman Babcock, chairman of the Alaska Republican Party.

Some 200 angry phone calls flooded into the party's Anchorage headquarters after Murkowski's speech on Friday, causing the phone system to crash until a repairman arrived to reboot it, Babcock said. That was a first.

A few hundred other objections arrived by email and Facebook, he said.

Only two callers who got through and a few Facebook posters said they supported Murkowski's decision, he said.

"Among Republicans the response is pretty uniformly negative," Babcock said.

Babcock, "shocked and disappointed" by Murkowski's vote, said he will send a letter to her by Monday seeking an explanation of her thinking.

Her answer will be part of a process that could lead to a public rebuke from the party's 83-member central committee, or worse. Options include trying to remove Murkowski in 2022, such as by eliminating party funding and other support.


Such a severe step is unlikely, Babcock said.

"I'm confident there will be a significant response from the Republican party, but I cannot say what," he said.

Murkowski, since winning a historic write-in victory in 2010 against Joe Miller after he upset her in the GOP primary, has ridden an independent streak to become perhaps the state's most powerful Republican.

She's enjoyed key support from moderate Republicans and Democrats, and the Alaska Federation of Natives, representing 140,000 Alaska Natives and an opponent of Kavanaugh's appointment.

Murkowski became chair of the Senate's powerful Energy and Natural Resources Committee in 2014, and holds key budget-crafting authority, critical in a state heavily reliant on federal support.

In the 2016 presidential campaign, both Murkowski and Sullivan denounced Trump and called for him to drop out of the race after release of a video in which the candidate boasted in vulgar language about forcing himself sexually on women. Trump won Alaska with 51.3 percent of the vote (Hillary Clinton had 36.6 percent).

After the election, Murkowski developed a working relationship with Trump. Last summer, she recalled a phone call with Trump after the election,. "He said, 'You know, I did well in Alaska, didn't I?' And I said, 'Yes sir, you did.' And I said, 'So, I wasn't one of those Republicans who supported you.' And he said, 'Uh huh.' And I said, 'But here's the deal: You won; I won. You want to do good things for the country; I want to do good things for the state. I figure we can be working together to do just that.' And he said, 'Absolutely.' And that's kind of how we have approached the issues that we've been working on."

In 2017, Murkowski was a critical vote in bucking her party and rejecting the Republican effort to repeal the Affordable Care Act, angering her party once again, and drawing a sharp Twitter rebuke from Trump.

The Trump administration threatened retribution for Murkowski's vote at the time, but the senator has continued to play a key role as Alaska's delegation has stacked up victories with help from the administration. That includes achieving the decades-old goal of opening the Arctic National Wildlife Refuge to drilling in December.

Murkowski has voted in line with Trump positions 83 percent of the time, according to FiveThirtyEight, a website that analyzes polls and politics. Sullivan was at 93 percent.

Casey Reynolds, spokesman for the American Civil Liberties Union of Alaska, which helped send more than 100 Alaskans to the capital to lobby Murkowski, said the senator holds the upper hand.

"I think a certain contingent of the Republican Party has tried to beat her before, and she's prevailed every time," he said. "I think she'll continue to do that. Alaskans trust her, and know she has their best interests at heart, and they will continue to support her for that."

Electoral College fixes that make more sense to me -

1) Prorated EVs - allocate based on % of the state's popular vote
2) Allocated per district - tie the EVs to the source of that vote. 2 per state overall vote (senator) and one to each congressional district.

Of course, these solutions are all up to the states themselves. If Californians, for example, were so worried about doing what is right they could change their EV distribution - you know, to be fair to those conservative Californians that have to be represented by Harris and Feinstein. This injustice cuts both ways and it is just so damned insulting for them to act like they are the only ones ever aggrieved.

The best part of this whole thing - Harry Reid changed the rules on confirmation and it came back and bit them in the ass in spades. Hilarious b/c Rs could be convinced to vote for qualified jurists they disagree with philosophically but not so with Dems. As such, the rule really helps Rs more than Ds. Since I am fan of judicial conservatism it is working out just fine now but don't think this won't turn the other way some day.

Judge Brett Kavanaugh’s hearings have re-opened a dialogue about Supreme Court Justice Clarence Thomas, and his confirmation hearing in 1991.

Attorney Anita Hill claimed that Thomas sexually harassed her, and an F-B-I investigation followed.

Some SCAD students are calling for a re-branding of the Clarence Thomas Center for Historic Preservation.

Many students WJCL spoke with say they had no idea the building was even named after the justice.

Alumna Sage Lucero started the petition.

She is one of many who says she didn’t know about the Clarence Thomas Center, and was shocked when she learned of it.

“I don’t want any other female who has hopes and dreams to have to walk through the doors of that building. They shouldn’t have to be subjugated to that toxic feeling,”- said Lucero, who graduated in June.

One senior who has signed the petition says the name of the building sends the wrong message.

“By naming a building after Clarence Thomas makes it feel as though sexual assault in the workplace isn’t taken seriously...In this current political climate with what’s going on with Kavanugh, something needs to change,” said Sarah Boussey.

Several students echo the sentiment.

“It should be renamed so we’re not glorifying that culture,” said sophomore Cameron Brown.

“I think they should change it. Just like all the buildings being changed with Confederate monuments,” said Lydia Baker.

Not everyone agrees.

“The claims were of sexual harassment in the workplace. Being a sexual predator means you violently sexually assault people.”

Senior Andrew Paynter says he’s neutral about re-naming the building, but takes issue with the language of the petition- which asks to remove a sexual predator’s name.

“Their bold claims seem to be too harmful. In our society, you just can’t accuse people of things,” said Paynter.

The petition has garnered more than 500 signatures.

Lucero says she’d like to see it renamed after Anita Hill, or see Thomas’ name taken off.

SCAD says they are aware of the petition, and have reached out to Lucero.

The Clarence Thomas Center for Historic Preservation was formerly a convent.

Thomas served there as an altar boy.

The building was named after him in 2010.

She want to change the name just like all the buildings being changed with Confederate monuments. While the building on the SCAD campus is the Center for HISTORIC PRESERVATION, some SCAD students and alumni seem blind to history.

Clarence Thomas is the descendant of slaves. He or his ancestors had no connection to the Confederacy aside from working for free and getting getting free room and board and no health care. Born in 1948 Thomas grew up during the era of Jim Crow laws, Brown v Board of Education, bus rides and beatings. His native language was not English but Gullah, a language based on different varieties of English and languages of West and Central Africa which was predominant among African Americans living in the Savannah (home to SCAD) environs.

The Center for Historic Preservation was formerly a convent and Thomas served there as an altar boy (not as a Confederate General). Recognizing his deficient skills in the English language, (Gullah was his first language) Thomas pursed a collefe degree in English Lit "to conquer the language". He got the degree cum laude. He later was admitted to Yale Law during Affirmative Action Admissions (which continue today). Thomas could be a poster child for the Civil Rights Era, a history that should be preserved.

But Thomas has 3 flaws. He's a Conservative Republican, he's not a woman, and Anita Hill alleged during his Supreme Court hearing that he made unwanted and untoward advances. Allegations that were made at the hearing but had never been pursued through either administrative or legal channels.

So his "Confederate Monument" needs to be renamed.

With the Electoral College, these come into play:

1. Nine or so states determine who is President
2. Gerrymanding by party controlling state legislatures and subsequent lawsuits
3. Population changes are based on censuses every ten years?
4. Increase spending with huge amounts of money concentrated in toss up states
5. Turnouts in non-toss-up states and interest in Presidential races is lower
6. Every other race statewide or districts is determined by popular vote.
7. Voter suppression
8. All that adds up to Power Politics and Big Money that expects return on their investments

Gerrymanding has literally nothing to do with the electoral college.

I told my wife this same thing an hour ago during the ceremonial swear-in, they are now targets.

For leftists, there was plenty to seethe with hate and anger during that ceremonial swear-in:

-Traditional Family being shown on TV. (not to mention their white skin)
-References to 'innocent until proven guilty'.
-References to The Constitution
-References to fair and equal treatment under the law.
-The American Flag being displayed on TV.
-President Trump speaking.

all things that leftists hate with a passion.

One thing that concerns me is what is now defined as sexual assault. Is exposing oneself really sexual assault? There's laws prohibiting that type of behaviour which I fully endorse, but I had always considered sexual assault an act where a person physically tried to force themselves on someone by grabbing, holding and requiring the victim to try to forcefully get out of the situation if possible. IIRC, I don't remember the Thomas/Hill situation being considered assault.

If an act like patting a woman's butt or a guy exposing himself is now considered assault, I'm okay with that. My problem is trying to persecute people for acts 20+ years ago that at that time were viewed differently by the public than they are today.

The victim-hood Olympics are so embedded in them, that her and the majority of her comment section can't wrap their mind around both things being true at the same time. Someone MUST be the oppressor and someone MUST be the oppressed and it's always cut,dry and monolithic... So in times like these just mock anyone who doesn't stay in their 'oppression lanes'...

The dozen judicial conduct complaints arising before and after Kavanaugh's confirmation process that were deemed "substantial" by a Federal District Court judge will be transferred out of the DC district to the 10th District Court by Chief Justice Roberts after Judge Merrick Garland recused himself.

The complaints in addition to perjury during his confirmation to SCOTUS are related to false testimony before the Senate in previous confirmations hearings in 2004 and 2006.

Those allegations had already been widely discussed in the Senate and in the public realm. Roberts did not see an urgent need for them to be resolved by the judicial branch while further complaints were incoming during his SCOTUS confirmation.

The American Bar Association has not completed their reconsideration of Kavanaugh's rating based on his conduct in the Senate hearings on concerns about temperament and honesty. They had previously downgraded the former White House Aide's rating of well-qualified to qualified in 2006.

The eight other Supreme Court Judges have all been rated as "well-qualified" by the ABA.

The American Bar Association has not completed their reconsideration of Kavanaugh's rating based on his conduct in the Senate hearings on concerns about temperament and honesty. They had previously downgraded the former White House Aide's rating of well-qualified to qualified in 2006.

The eight other Supreme Court Judges have all been rated as "well-qualified" by the ABA.

Dems cant let it go, they lost the sexual assault stuff sonnow they need to attack his judicial record. Its sad, but it is what it is.
