Judge rules against Brian Kemp over Georgia voting restrictions days before gubernatorial election

Georgia must change its procedures to make it easier for some people flagged under the state’s restrictive “exact match” law to vote, a federal judge ruled Friday, dealing a blow to Republican gubernatorial candidate and Secretary of State Brian Kemp.

The “exact match” law flags voter registrations that are found to have discrepancies, such as a dropped hyphen, with other official identifications. Potential voters are allowed to settle the discrepancy by providing proof of identity.

But the state’s procedures under Kemp, whose office oversees elections, stipulated that those who had been flagged as potential noncitizens be cleared first by a deputy registrar when seeking to vote. In October, a coalition of civil rights groups sued him.

U.S. District Judge Eleanor L. Ross ruled Friday that the procedures were likely to result in the violation of voting rights for a large group of people and needed to be halted immediately. She said Kemp’s restrictions raised “grave concerns for the Court about the differential treatment inflicted on a group of individuals who are predominantly minorities."

Kemp’s actions as secretary of state have been scrutinized in the wake of a report from the Associated Press that he had stalled more than 50,000 voter registrations by disproportionately black voters under the state’s exact-match requirements.

The action raised fears of voter suppression, accusations that were made more incendiary by the implications in a state that, like many others in the South, bears a painful legacy of anti-voting tactics aimed at the black population.

Kemp’s involvement in election procedures while a candidate has also drawn criticism. During a debate with Abrams, Kemp said that he would not recuse himself in other election-related issues either, such as if the race were close enough to trigger a recount.
Ross also ruled that if the exact match rules were kept in place, it could cause people with suspended voter registration applications “irreparable harm if they lose the right to vote.”

It's sounds a little racist to me. They are making it sound like African Americans are the only ones that can't get get it right.

Also, if dems were so concerned, it's very easy to fix the situation. Dems have a ton of deputy registrars. Anyone can become a registrar in a one hour training course in regular classes all over the state. Trainers actually come to you if you can get a group of 15 or more..

Gillum is a big league clown. I honestly wouldn't be remotely surprised at him getting indicted. He's received a good bit of stuff from undercover FBI agents.

Even among registered American Indians and Alaska Natives, the turnout rate is 5 to 14 percentage points lower than that of many of the registered voters of other racial and ethnic groups.”

No matter what happens after the 100-day mark, this has already been an historic cycle for Native American women running for office. There are top-tier candidates for Congress, statewide office, legislatures, and even more running for corporation commissions, county offices and city posts.

Debra Haaland from New Mexico is favored to become the first Native American woman elected to Congress with a 98% chance of winning over the Rep candidate, polling 54% in favor. Native Americans make up 10.6% of New Mexico's population. Turnout in 2014:

The have an early voting site close to my home. The parking lot has had a lot of cars in it every day and today the line extended outside by about 40-50 people. About an hour and a half later the line was still there. It will be interesting to see what happens with Donnelly and Braun. They're now saying Donnelly has a slight lead but that was before orange hair came to town for Braun.

Waited over an hour yesterday...even longer wait today. Record early turnout in northern Indiana.

I voted. Never had this much of a wait. Other polling places reportedly were more busy. Love early voting.

Ballot initiatives in Colorado include:
- Repeals a constitutional exception that allows slavery and involuntary servitude as punishment for a crime
- Establishes independent commissions for federal and state redistricting
- Establishes income brackets (currently a 4.63% flat tax) to fund education (remember the teachers' strike). Brackets would begin at incomes over $150,000 ranging from 5-8%.
- Changes campaign financing law to limit to one million dollars the amount one candidate can contribute to his/her campaign (the Democratic candidate for Governor, Jared Polis, has been funding his campaign with personal donations. He is worth almost $400 million)
- Funds transportation projects - one initiative without raising taxes, another one with taxes to repay debt

and the Big One:
- Mandates that new oil and gas development projects, including fracking, be a minimum distance of 2,500 feet from occupied buildings and other areas designated as vulnerable. (the current setbacks are 500' from homes and 1000' from schools)

Seriously might not sleep tonight. One of the more interesting mid-terms to me as I look to see if the traditional polls are wrong again.

Tin foil hat theory of the day - heard a few people talking about weather reports trying to make out like you have to really brave the elements to go vote when it is just normal November weather. Tied to Dems wanting low turnout. Like I said, tinfoil hat. Interesting that some of the undercurrent is Dems wanting lower turnout though.

I absolutely fucking hate the idea of "make sure to vote!" ... if you have to encourage someone to vote with Twitter ads, celebrity endorsements, TV ads, etc. chances are they shouldn't be voting. If you have to be convinced by paid media to get off your ass and vote chances are you're a low-information voter who frankly shouldn't be involved in the process.

Agree 100% - always amazed at the folks who get offended by this position. Usually the same folks that can't name their own governor or think there are 57 states.

It will be interesting. I have a feeling I'll be up late as well. The norm/average for the midterm after a new prez, is for the incoming party to lose 28 seats in the house. Dems need 23 I think.

Nashville has generic billboards up reminding us. I'm sure they're paid for with tax dollars.

I am of the firm belief that the fewer people that vote, the better off we all are. It's scary how many "reminders" we get about voting in today's society. Hell, it's scary how many initiatives there are just to get people registered. This isn't a race or disenfranchisement or suppression issue at all-- it's a pure common sense issue. People that can't figure out how to register to vote, or even actually vote, are essentially deciding our collective future. Again, that is scary stuff.
