Okay so we get the employees name and then we get the daughters name..

not accepted...invited. Look the kid was on an academic scholarship. Thats not like some kid who "got in". Unless someone somewhere changed what it meant to get an academic scholarship to a prestigious university. Those kids rarely fuck up...

That said. Total speculation here...but, If he did fuck up, he would be more desperate than someone who "got in", 1) as I presume the academic requirements to stay on scholarship are higher than those for merely staying in school. 2) He couldn't just pay his way and take on the lower standard.

This would paint a completely different picture regarding how believable he was/is.

Who cares about the attorney...they are damn near promoting the name on some news stations locally. He was interviewed on camera today and was well know before that.

The mom and daughter are easily found as well...

What do you define as a kid who "got in"? Why the quotations?

In regards to having to keep a higher GPA to stay on school granted, need based aid vs. students from wealthy families who are paying 100% of their TR&B out of pocket... I have no idea ND's stance on that.

Any ND alumnus wanna weigh in?

If he was on merit based money ...maybe a lot. Don't know his financial situation, but if you have an academic scholarship, you don't want to lose that. Generally people who have academic money are required to perform at a higher standard than the normal student to keep it. Honestly if ND is different, I wouldn't know.

Someone who went through the admissions process and was granted admission so long as they could meet the financial requirements...ie pay or qualify for aid...to differnetiate between academic scholarship awardee and someone who is a normal student

Never met a kid awarded an academic scholarship who failed out or was dropped from the scholarship. Know many kids who were high test scorers, got in, and later failed out due to poor study skills.

the point I was making is that it would be an odd situation and may make the kid desperate...which makes his story questionable at least.

Based on the complaint, would seem like ND could easily have a solid affirmative defense. Every allegation is intentional conduct by the employee, clearly outside the scope of employment. It's borderline frivolous.

Obviously having the student fvck her daughter while talking about his BBC is outside of the scope of her employment, but if she was leveraging her position as a tutor I don't think it's so clear. To use an easier example, we'd all agree that a school would be liable if it turned out a male teacher was fvcking a high school girl during detention, right?

Been a bit since I was there but I definitely knew kids who had academic scholarships who had to maintain a certain GPA for it to be maintained. I also knew people who were the smartest kid in their whole damn county - and probably had academic scholarships as a result - who walked in to Notre Dame and felt in over their head. Especially as freshmen.
So I could see someone in that situation feeling pressured and making some mistakes.
What all that has to do with football players and intercourse and some skeezy lawyer angling for a settlement, I have no idea.

it is a simple distinction...many submit applications and some are "accepted" into the University. Some kids are provided an academic scholarship (merit based), and may even be recruited/"invited" to attend the University (honestly don't know if ND does that, however many schools do). At the very least they are invited into a scholarship program.

The operable distinction is, kids who are accepted normally are required to maintain...say a 2.5 (guessing), or they are put on academic probation, and may be kicked out at some point. Kids who receive a merit based scholarship are often required to maintain ...say a 3.3(guessing), or they are not offered the scholarship the following year. This may be the problem for John Doe...and if he can't afford school any other way...it might explain how/why he used a strange situation to make himself a victim.

I noted earlier that I've seriously never known anyone who got a merit based academic scholarship to tank it. It is obviously possible, but those kids seem to be made differently...they have the grades, the test scores...recognition for extracurricular endeavors...they have their shit together. Its not like they are the disorganized/disinterested smart kid.

To me John Doe needing a coach was weird....I noted it...but it is not really the crux of the issue...its just an observation noting weirdness among other weird shit.

I am saying, this kid's actions seem to show he was indeed in some academic peril...since he sought out the academic coach...

would it be crazy to think he heard about all of this sex business and sought out a ready-made excuse for tanking? Or he legitimately sought help, and all of this happened, and then it occurred to him to use it?

FWIW...the column today in the NY daily news states...

"The student is now demanding a jury trial, injunctive relief from the University of Notre Dame and for school officials to honor his scholarship while beginning an independent investigation into his accusations."

such an investigation might take...long enough for John Doe to pull grades to save himself maybe?

So whatever happened, I think it is safe to say he had academic issues, and that those likely preclude him from attending Notre Dame w/o mitigating circumstances.

As for the Pimp and her daughter...weird people...fired. Moving on.

The timing of this suit may also support your claim, namely right after midterms. Perhaps his midterm grades continue to threaten the loss of his scholarship, he sees the writing on the wall, and then runs to a lawyer with his story.
