I haven't read every post, so maybe this has been already explained away...but I feel the hold up now is the fact that this 'tutor, or whatever you want to call him/her" was paid by the university, and that now escalates this whole thing. Throw in the fact that apparently some inappropriate behavior has happened(cheating, plagarism, whatever, etc) which is tied in with someone that was paid by the University (even if only briefly) then it appears that the person that helped these students 'cheat' was paid by the university; there in lies the problem (or the perception of the university being involved with the cheating)

I'm taking the position that we wont see any of these players on the field this year, just because of the 'perception that the university paid this person to help these students cheat'

Bingo! That's where i fall on this. Whatever the situation, it's got to be somewhat complicated. What do you think will happen to the tutor?

Are there any lawyers on here that can answer a defamation suit question?

At what point does an accused person, who is later found innocent, get to turn around and sue the accuser for defaming their name with a false accusation?

Point and case, we had a QB at Montana that was accused of rape by a girl. He had to sit the entire football season during the trial only to find out the girl was upset she gave it up and then he wouldn't date her afterwards. Kid lost an entire year of playing + had his name in newspaper headlines for rape for a year as well. IF I was one of these 5 players making ESPN headlines for "academic fraud" and I was innocent I would want some type of payback from the University for the games missed + the "cheater" label that was attached to my name.

That is the problem with certain accusations...even IF you are found not guilty people still look at you shady and wonder what happened.

Has the University accused these guys of cheating?

Which could be a problem in its own right. If his grades are so borderline that he's on the verge of getting kicked out of school, even a failing grade for a paper or a course could be enough to push him below the acceptable GPA, even if there wouldn't otherwise be such a severe penalty for the cheating alone.

If it is just the case of a failing grade and it happened say 2-3 semesters ago, wouldn't he have already served his penence since he was suspended last semester anyway? Or am I missing how that all works. I could see if the grade was from this past summer but anything prior to the summer he would have already gone on academic probation and then sat out a semester suspension, correct? He wouldn't be suspended a 2nd time for something that happened prior to his 1st suspension would he?

This could be the key. Roll the doobie. "Flambé." Inhale. Roll the dough. Throw whatever you like on it (tomato sauce, veggies, meat, cheese, fruit, quinoa, etc.) and bake briefly at a high temperature.

Has the University accused these guys of cheating?

An investigation took place to determine the extent of what happened. Then the information was turned over to the Dean and the Honesty Committee who apparently hasn't done anything with it. So to answer your question, no, they have not been accused of anything. That's what the next step of the process is for.

If not seeing the field this year was in the cards then I'm even more upset with the university than before. If that's the case then they should have informed them AFTER they said the investigation was concluded so that they could have transferred. That would be the biggest disservice to them.

If ND didn't know the kids cheated when they played there is no precedence to vacate wins.

If this is just getting a hearing scheduled, someone is sucking badly.

If there are any overarching legalities other than Honesty Code, or students cheating, this is a poorly written legal drama.

If this is about documentation of sex, or any permutation, then the expelled students could sell their stories for beaucoup bucks, for a made for TV movie.

If this is a definition kind of thing, as in, "I know cheating when I see it,"even if it doesn't conform to the guidelines of du Lac, as a violation, then we have something. Does anyone know how well defined the student guidelines on papers are defined in this computer age?

It makes no sense for him to be "gone" before official word. He can't transfer anywhere mid semester and he can't transfer in D1 because he'd have to sit out a year and next year would be his fifth year

Daniels is being intentionally ambigious b/c he likes the attention/needs to blow off steam (You might note Kendall Moore and Ishaq Williams have been pretty much Twitter silent since this started. If the other two tweet, I've never seen it.). We have no idea what he's talking about. He's basically trolling us. Not that I blame him.

But to declare "he gone" doesn't make sense. Where's he going to go? Or any of them? Transferring means sitting out next year, not playing until 2016. The only one that might make any sense for is Russell. The rest will be, what, sixth-year seniors by then? Or they play out the string at Notre Dame in the hopes of coming back this season. If not, they go to the NFL, or come back next year, or maybe in the case of DD or Ishaq do the fifth-year transfer thing (though for that they have to graduate first, which could be an issue).

Either way, a transfer's unlikely and nothing's probably decided until either the investigation's over or the season's through. So can we stop over-reacting to every Toot tweet? Please?
