Am I the only one here that thinks that getting any punishment other than by Coach Kelly for saying 'my people gonna get you' is ridiculous?

I just can't imagine filing the paper work to send a kid through the system for this 'offense.'

Give me a break. It's like when refs would hit Rasheed Wallace with a technical foul for looking at them mean.

Not guilty plea entered for Notre Dame QB Rees | Washington Examiner

SOUTH BEND, Ind. (AP) — Notre Dame quarterback Tommy Rees made an initial appearance before a magistrate and a not guilty plea to four misdemeanor charges was entered on his behalf.

Rees is charged with one count of battery, two counts of resisting law enforcement and one count of illegal consumption of alcohol by a minor. South Bend police say he fled from an off-campus party early May 3 and pepper spray was needed to subdue him.

Rees didn't speak during Thursday's court hearing, which lasted less than a minute. Neither Rees nor defense attorney George Horn would comment afterward. Rees is due back in court July 17.

Linebacker Carlo Calabrese didn't make an appearance on a misdemeanor count of intimidation. He is scheduled to be in court June 21.

Just curious: how does Rees plead not guilty on the minor consumption charge?

The move is made to plea for a lesser charge: especially hoping that attorneys may have met with the DA already

-or-

Posture hoping for dropped charges due to inefficient evidence.

Those are my two guesses.

This lawyer has appeared in some pretty big venues [ex. in front of Supreme Court, prosecuting Tyson, both sides of the prosecution/defender role].... has someone rolled out a big gun here?

Not surprising, he is not going to plead guilty right now, but he will get a plea bargain before this actually goes to trial. I wouldnt make too much of this to be honest...

Seriously? You don't EVER plead guilty to ANYTHING unless you're getting a deal. The burden is on the prosecution to prove the charge. There is literally not one reason to make their job easier for them.

I honestly believe there needs to be at least a little bit of law taught at the high school level. These are pretty basic concepts. It is elementary to how the system works.

Not really honestly. If you look at the Indiana penal code, it fits. To he considered a felony, the charge has to have a minimum punishable offense of at least 1 year. Anything lower is a misdemeanor. For example, I believe that his offense is punishable by a maximum of 6 months in jail. Which would be a Class B misdemeanor. The charge sounds worse then what really happened.

(I'm on my phone so I'm going off the top of my head. I could have made errors so if somebody can correct me, go for it.)

Yeah I understand, but I was just wondering about this charge in particular because (a) he's a minor, and, (b) he was found to have alcohol in his system at the scene of the 'crime.' Not sure how you fight that one...

Probably the reason he has a top drawer lawyer.

Rees has multiple charges, not just underage consumption, which will probably be plead down together in a deal. There's no deal to negotiate if you plead guilty at the start.

O.J. didn't plead guilty. Claus Von Bulow didn't plead guilty. Sam Sheppard ...


I've been to traffic court 5 times where I pleaded Not Guilty and 5 different judges agreed. I never had an attorney. They were common sense issues. Not everything is a slam dunk. You can't win or even draw unless you try.

You don't fight that one. That is part of the plea agreement. Tommy will admit to minor consumption if charges of battery get dropped, for instance.
