Isn't the purpose of tests to assess whether someone is capable? What's next, dumbing down the Bar Exam, Medical Boards, etc. until everyone can pass? Just wild.
Not “everyone” just… (clears thought) “those” people….

You don’t have to dumb down the exams, they just change the entry level requirements based on race, and if recent court cases have taught us anything, if you don’t, you’ll be sued for millions of dollars in damages

So you are only discriminating again. So the other side should sue.

This is insane.

I would ask was it the whole test or specific sections of the test that were found to be problematic?

The Human Relations section in the sample test had questions that are pretty subjective in nature.


The article above states that the test was not “job related” and the test composition was as follows:
  • 15 reading questions
  • 20 math questions
  • 20 writing questions
  • 15 map-reading questions
  • 30 questions on interpersonal competency and human relations
  • For two years, an additional section added 28 reasoning questions.
I can see those last two sections being pretty subjective based on the sample test provided and therefore problematic.

Seems to me that those skill sets would be better assessed using an in person interview and reference check.

Seems like this might not be as “insane” as first presented.

Disparate impact discrimination occurs when neutral appearing criteria burden a protected group. The EEOC and the DOJ have established an 80% requirement for disparate impact, meaning that if the success rate of a minority group is not within 80% of what the majority group’s success rate is, the process is presumed to be discriminatory.

In this case the failure rate for African-American candidates for the written exam was reportedly 37%, while just 11% for whites. Analyzing this from the perspective of pass rates, 89% of whites passed compared to 67% of African-Americans. This equates to 67/89 = 75%. Alternatively, a white failure rate of 11% compared to an African-American failure a 37% rate equates to a difference of 29.7%. In either case, the 80% rule would have been violated.

It’s about the numbers failing NOT the test itself. So they won the suit and $1m for failing a test.

DOJ is out of control.

This is just another way of weaponizing the judicial system to force agencies and businesses to go full-on DEI or get sued. But using the criminal and civil court systems to do this isn't a threat to democracy, though.

Not sure anyone thought or hoping she were one. I’m just sad for the WNBA they don’t have a reason to beat her up now.

Sure, I'm in. And to take it a step further, eliminate the Federal Dept of Education.

At the state level, let governors approve school choice, dissolve teacher unions, and don't trap minority children in awful school districts with no alternate options.

Racism demand greatly outstrips the supply. Its not even ironic the vast majority of the supply comes from the ones demanding it.

It just shows she has permission to say it. If people were completely honest and transparent you would see more of this from all sides. It’s amazing how some people feel the need to walk on egg shells when speaking not to offend but then there people people in certain groups/subgroups that don’t even hesitate to offend. Racism has literally been redefined by dictionaries to give different groups open season on the majority (white people).
