It's sad that in a crisis such as this, litigation worries are so prevalent.

I'm a business owner and this pandemic has already taken a real toll. We had to give layoff notice to about 30 employees last week. We are currently classified as essential services.

Small businesses (in Canada) have been the low hanging fruit for many litigation lawyers and Human Rights Tribunals.

From the information provided thus far, and dependent upon its veracity, there appears to be 2 parties that are culpable (1) the Chinese government and (2) The Word Heath Organization.

If justice is to prevail, these parties must be held to account.

Cheers and Go Irish!!

I think there are many of us that agree. Why Is it that you personally feel this way?
The pundits have their reasons and If we listen long enough to our favorites we all will start their wish of following. Their try at our indoctrination of semi-factual events is changing daily...

I wanna know why people listen, and form opinions off of other Right/Left opinions.
I'm positive you know the ways of understanding and reality are up to us, and I listen to talk radio all day everyday. Just bc? Sometimes, It seems to correlate with our inner being and that doesn't always mean It's factual...

If ya listen to Rush Limbaugh; he himself claims he Is the lord and savior of the world in and of itself... Kinda odd... Then he will say something that makes complete sense and I have to check my attitude.

Just curious and politics aside, why are so many divided by the same feelings of hopelessness....?

She died btw. Found the gofundme, her family and friends on facebook. Seems a lot of work to ferret out a moron.

1 minute google search...
Moron or hoax, we know we have a lot of both in this country (and yours).

Why would NY donate when they’re epicenter of the nation. Someone said the state has more cases than every country except 3 maybe 4 nationally. Help me understand.

I was talking about NY being on the receiving end, like they were when Oregon shifted supply. I'm suggesting this may be a positive sign (NY perhaps now feels they have enough).

The models predicting cases, death, ventilators and beds needed, are being lowered a bit right now.

Courts are very deferential to executive authority during states of emergency (as they should be).

Imagine someone suing the Office of Price Administration in 1942, during the run up to WWII, because rationing was "violating his rights as an American".
Try Japanese internment.

So what's your point? That the flu with it's vaccines and FDA-approved OTC medications has a death rate of .0011% this year?
COVID-19's death rate is nowhere near what's being reported. They did some free testing in Iceland and something like half of the people tested were entirely asymptomatic. We're vastly under-measuring total cases, meaning we're vastly over-calculating the death rate.

Like many doctors have said, we simply don't have a valid denominator.

George from Star Trek played a funny game on the 1st. His family was one of those that underwent that Roosevelt era craziness. and no one questioned It..... Times are changing for the better and we still all sit around and bitch about things we can't understand...

I've mentioned testing speed and availability as primary to opening things back up. The NBA is now assessing rapid-tests as a potential way to get back on the court.

https://www.espn.com/nba/story/_/id...-assessing-potential-covid-rapid-test-options

The pregame changes..... show up, shower, and be quarantined. Get tested and wait on results (guessing less than 5 minutes). Go warm up with others post testing. Play game. Get tested again. Go home. Rinse repeat...

This is what made me angry:

https://en.wikipedia.org/wiki/Li_Wenliang

The dates are important because The WHO (not the band because they are great!) had am opportunity to react and warn the rest of the world. Sadly, that did not happen and here we are.

I'm additionally upset that I have been in isolation for the past three weeks instead of at work. I had a sore throat, runny nose and was sneezing a fair bit. My Doctor asked me why I was going to the office. I replied, "leadership by example". He told me, "that's exactly why you shouldn't be going in!".

I have not been a contributor at work since I suffered my strokes. I figured I was a liability and chose to take his advice but I cannot shake the guilt when I talk with my coworkers every day.

Stay safe and be responsible all.

Cheers and Go Irish!!

lol. yup. I think at first though they'll go fan-less, just skeleton crew, and everyone allowed in or near the court will get tested. "Friend of friend" type chatter stuff I keep hearing is that they want to simply get back on TV. Bayern Munich and Budesliga has already returned to training.

Have you been able to access the loan assistance program yet the CRA is facilitating? Has the wage subsidy kicked in for your business?

I had a client nearing retirement just close up shop last week and will liquidate the remaining inventory.

Saw it's trending positively out there in AB. Get things back soon so the stampede comes back!

Thanks TorontoGold,

Thankfully, my partner is a CA and is well on top of things. As you know, Alberta has had a pretty rough go over the past 4 or 5 years. Oil prices are complicit but this pandemic really hammered out any optimism or investment capital in the industry. On a consolidated basis we are probably (revenue wise) 85% reliant on oil, gas and mining with the balance coming from food production, construction, tech and agriculture.

I probably share to much on this forum...LOL. We will be fine but some tough sledding ahead.

Thanks again!

Cheers and Go Irish!!

Very sorry to hear that your business has suffered such a downturn and you had to layoff so many workers.

Here in the U.S. we may be one of the few countries that ties health insurance to employment, so many of those laid off are scrabbling to get coverage in some way in addition to filing for unemployment benefits.
The last two weeks here 10 million have lost their jobs and 3.5 million of those have lost their employer sponsored health insurance. (Economic Policy Institute)

Are those Canadians laid off able to maintain the same coverage, providers, med benefits etc.?

Cheers back at you.

Boris Johnson Admitted with symptoms

I'm going to guess that at some point, during a quiet moment alone with his own thoughts, he's really regretting going out and about while shaking hands with all of those positive cases.

I don't know much, but I do recognize the way us human beings need social interaction in order to survive. We have holidays that have been around for awhile in order to make everyone involved uncomfortable... (at least that's how I used to think). LOL
The evolution of our species has become a thing that we can't deny any longer. It is why we get sick to our stomachs when we hear of the atrocities that people do to one and another.
Let's cool our jet's and realize we are still the same thing that needs Love and Understanding... A Hug, a simple touch... like a hand shake. We are still human.
Why are we fighting the most natural way of our being for something we are yet to understand?....

So, I have to differ with Oahu on "triaging based on the assessed value of one's life" or "triage policy". Even with a homeless John Doe, who has no family that can be reached, and has signs of brain death, must have an appointed guardian to assist in making decisions on necessary life support measures. Those are then reviewed by a judge under most state laws and will then make his/her decision. Of note too, one out of every four hospitals are now owned by the Catholic Church and guided by their religious dictates.

I believe the Emergency Declarations and Presidential Proclamation essentially remove this normal fail-safe, however. The burden and responsibility of the community health apparatus becomes ensuring that the whole survives, not the individual, per se. That code I linked in my response to Wizard, 42 U.S. Code § 247d–6d, essentially states that as long as there is no willful misconduct, you're immune to suit and liability.

I'm not a lawyer, though, I could be wrong. That's just my interpretation of it.

I continue to believe we're tracking towards a "return to normalcy" in June. At least if people start actually adhering to the fucking social distancing guidelines.

Went downtown last night to pick up a couple of boxes of N-95's from one of the boys. Looked pretty eerie. There was a group of about 8-10 waiting at the bus stop and they were so close to each other it was like they were in a huddle talking.

PR nightmare coming up. Imagine the outrage when the NBA is using tests kits on the same people over and over just to play a game while many go without getting tested.

I got an email late Friday we had laid off a lady in shipping. Evidently a couple of weeks ago she had written a couple of emails to the owner saying we were putting everyone's lives at risk because we were open. She claimed we weren't essential and needed t close immediately. We have a number of customers that are currently making respirators, a DoD contractor and several other large companies that are deemed essential business. So Friday she has a melt down and goes off on her manager because we are still open. It was sad to hear this because she was a very good worker and typically a quiet person. This pandemic is effecting a lot of people in different ways.

Saw on the news some companies are using cell phone tracking data to determine how well each state is practicing social distancing. For the most part every state sucks.

Saw on the news? What news?
Imho, we need to have news that Is non-profit. We as a society can not keep this news-cycle. We all need facts not opinions!, and if they went non-profit It might get ugly in the beginning but podcasts and real human interaction with real stories would change people quickly.

Most states have “shelter in place” right now. I assume most of you are under that in your respective states. How truly restrictive is it? Can you still go to the store for supplies/food/Rx? Can you take walks around your neighborhood? Can you go through drive thru restaurants for pick up orders?

Just curious.

Excellent find. Kudos.

Not a lawyer myself, either. I'd hazard a guess that the "liability protections for pandemic" actions depends on the definition of "covered persons".

(a)Liability protections
(1)In general
Subject to the other provisions of this section, a covered person shall be immune from suit and liability under Federal and State law with respect to all claims for loss caused by, arising out of, relating to, or resulting from the administration to or the use by an individual of a covered countermeasure if a declaration under subsection (b) has been issued with respect to such countermeasure.

link provided for "covered person":
covered person
(2) Covered person The term “covered person”, when used with respect to the administration or use of a covered countermeasure, means— (A) the United States; or (B) a person or entity that is— (i) a manufacturer of such countermeasure; (ii) a distributor of such countermeasure; (iii) a program planner of such countermeasure; (iv) a qualified person who prescribed, administered, or dispensed such countermeasure; or (v) an official, agent, or employee of a person or entity described in clause (i), (ii), (iii), or (iv).

Does Trump declaring a National Emergency of HHS declaring a Public Health Emergency protect entities like ambulance services, hospitals, etc from liability?

I have no idea.

Anyone who donated plasma at those banks has already been implanted with a microchip by the federal government and they have been tracking your every movement for more than a decade. You know it to be true.

I am on the verge of belief... Is this a theory that I have yet to read about?

Same for Ohio. They encourage you to stay home, but it's restrictive when you do go out. You can't sit in restaurants, it's take out only and in some cases drive thru only. For sit down restaurants, many with two entrances now have an "Exit Only" and "Entrance Only." I went to one last night where the doors were propped open so you don't touch them, and they had arrows taped down to the floor to show you where you stand until your food is ready. Take out orders were huddled together on a large table, all other tables in the restaurant are gone.

Stores have Entrance/Exit only too. Wal-Mart has locked all their entrances except for one, and even that has been sectioned off with carts so one sliding door is entrance only and the other is an exit. Other than that, shopping hasn't really changed. For some reason self checkouts are allowed to operate normally, people aren't 6 feet apart there.

You can go to a park to walk, but you can't do anything else. Amenities like fountains, playgrounds, picnic areas, etc have been roped off with yellow tape to keep people away. There's even a small, private park behind my house that has been roped off.
