After bleeding DLs, 'bama finally gets one in the portal.

We should call UO; DL Transfer U.
...an NIL deal with the University? Impossible.

Did you mean a rev sharing deal? NIL deals are not made with the schools.
Everyone is talking about these Nils as though they were made with the school. Perhaps it's now normal for the school to be named as a party even if the booster is paying the tab.

I don't think Miami has to tamper to get find a QB. The need is well known and I think it's pretty reasonable to believe agents are reaching out to Miami on behalf of their QB(s). Wouldn't doing that be a part of the agent's job?
Whether or not they HAD to is not the issue, the fact that they did, how they did and when they did is the issue.

I think all of us are assume things, but is the idea that agents are shopping their clients that bizarre?

What the fuck is Miami supposed to do in that situation? Not answer the email/call/text? If the Duke QB's agent calls to see if there is interest in his client, and Miami has interest, are they supposed to say "no, the timing is wrong"?

People want to... cry for Duke? Shake their tiny fist at the sky and clutch their pearls for the sanctity of cfb? If it's within the rules, but you want to then say "not like that"... probably should fix the rule.

It’s the fact that signed contracts are being rendered meaningless because there isn’t an entity with the power to enforce them. That is the biggest issue I see.

of course there’s an entity that can enforce this. The question is whether the entity wants to bring suit. The discovery in a tortious interference case could be spicy.

Fair. Should probably say, “there isn’t an entity willing to enforce…”

Which kind, endorsement deals or revenue sharing contracts? We just saw Washington's QB decide it wasn't worth breaking his revenue sharing contract. I think our system has a robust legal process to handle disputes over revenue sharing contracts.

NIL deals are basically the same endorsement deals we see in all professional sports.

The money isn't going away and cfb is a ruthless year round business that isn't going to pause unless something bigger makes it.

Yep, just was curious if he would stick at LSU with Kiffin. Plus, their dad named permanent AD. That’s all. lol
Ha. Yeah, I would guess he's not being pushed out. Probably just wants to actually play at some point. In four years at Auburn and LSU he hasn't really (He appeared in 12 games in '24 but had no stats, so guessing a special teams guy?).
Maybe at Baylor he can see the field? I dunno.

Apparently ready to sign with Miami. This is going to get ugly. NIL and the portal are such a mess, if he manages to get out of this, it will only get swampier.
I can’t wait until players start “portaling” outside the portal window.

Saw this on a Duke board. Apparently this was in the contract:

I mean...... I dunno if that kind of provision is legal/enforceable, I kind of doubt that it is since NIL is explicitly not supposed to be conditioned on playing for a school, right? But I have a hard time seeing there not being damages of some sort found in this case. And I also think the ACC is a joke of a conference to be silent on this.

IANAL, but...
  • worst case for Miami is that Duke files an injunctions and keeps Mensah from enrolling in time for Spring ball. I can't see this staying in the courts late enough to keep him from enrolling for summer and fall camp.
  • worst case for Mensah is he has to payback everything Duke paid him, plus damages. More likely is that the courts would settle on a compromise number
In the end, it'll come down to some number that Miami/Mensah have to pay Duke and both will have to decide if it's worth it.

Keep in mind that if Mensah has done a decent amount of financial engineering, he can likely protect much of his earned money from Duke and...

I think it has to be the rev share contract, as that is the only contract I know for sure that Duke is a party to. As I understand it, in order to for NIL deals to get approved by the clearing house they need to be done directly with the third part (rhoback, etc.).

Wait until they re-broadcast the lawsuit on repeat the week before the CFP selection.

Duke has the opportunity to send a message here. Send the full might of their university at this kid and then at Miami if need be. Turn this into the ugliest fight they can. Every school except Miami would back them just like everyone backed Heupel when he told Nico to go f himself.

Wouldn’t a rev share contract be different?

This. NIL isn't binding to my understanding. I thought this was a Demond Williams situation. I DOUBT a court would rule in favor of Duke here, but it would be huge as teams would start putting this into all their contracts.
