For the attorneys out there, can Manti sue deadspin and or ESPN for initially basically saying he was a liar, started the hoax -80% sure bullshit???? I would love it if he couls sue the **** out of them.

Slander maybe? I am not a laywer, but maybe. I can't believe we are still talking about this. The doucher who tweeted that to TJ needs to be found.

No, you can't. Not unless Deadspin fabricated the "source" that said they were "80% sure" based only on a bunch of assumptions of Tuiasosopo's con artist abilities + Te'o's gullibility. And you could never prove they fabricated the anonymous source.

I'm no lawyer but with defamation law I'm pretty darn certain that you have to be able to prove that a statement of fact was incorrect due to either malice or negligence. It doesn't seem like Deadspin ever made a cold hard statement of fact in the first place. If they flat out said "Manti Te'o concocted a hoax" then it'd be a different discussion... but all they did was was cite a source's statement.

If anything, Te'o could sue that source if he ever got his/her name... but the fact that they said "80%" would make that darn near impossible unless you could prove that they knew he wasn't involved at all... which is is dubious at best.

So bottom line? Doesn't seem like anyone really has any legal exposure.

The guy who tweeted at TJ could DEFINITELY be sued if TJ claimed emotional distress. That's not even a stretch.

In short, probably not. Manti is a public figure, which means he has a much higher hurdle to clear in proving libel than the average Joe. He'd have to prove that the Deadspin article was actually false, and that the authors published it with reckless disregard for its truth.

The article was 95% true. The only thing approaching libel in it is the anonymous source stating he's "80% sure" Manti was involved for the publicity. That's not even close to sufficient to sustain a libel claim involving a public figure.

Plus, I think public figures (which Manti is, as opposed to, say, your Aunt Sophie, probably) have a very very tough row to hoe to win defamation suits. New York Times v Sullivan is the case New York Times Co. v. Sullivan - Wikipedia, the free encyclopedia , but I defer to the First Amendment lawyers out there.

I don't even think Manti would do that(sue) to anybody including his worst enemy. Manti is too good a person. He made some poor choices along the way but my god he's still just a kid even now at what 22? He will get through this and learn from it. There is no doubt in my mind that Manti Te'o will succeed in everything that he does and most importantly the game of life!

It's been a tough couple weeks to be an ND fan but we are still heading in the right direction so fear not and just continue to be the loyal fans that you all are! With ND there will always be something going on that gets blown way out of proportion just because it's ND and so many hate us. You're either all in or you're against us is how I've always seen it.

All of these things are held as fact by many in the world of sport for various reasons despite none of the above having anything to do with reality... Hooray for American Media/ myopic fans...
Bravo ACamp-anything said from here on out by the media is just to speel their spew. This kid is innocent and Notre Dame will survive. He was guilty of caring. Case closed.

Things like the Dallas Stars did and that baseball team and Kentucky is planning to do are sickening. As far as we know right now, Te'o was legitimately duped. It would be one thing if he were behind the hoax from the start, but the fact that he is being made fun of, as the victim, is a little unnerving and everyone who takes advantage of his terrible situation for a quick laugh should be embarrassed.

EDIT: I'm not talking about the jokes. Those are relatively harmless and actually really hilarious.

Seems like a contradiction between your two statements, if he is legitmately dooped, then he shouldn't be made fun of... but jokes are fine?

That would let ND off the hook too easy and ESPN has no intentions of dropping this. I know this isn't what we want to hear but as much as I love T'eo as a player on the field, he should have had this senses turned on. How can you let something like this happen? I keep looking at how much he said about this girl on camera and I remember how I had the impression like they were probably going to be engaged and he had to have spent a good amount of time with her. As a fan, I feel betrayed. We can pretend that this wont have an impact on us in the future but the reality is that it most likely will.

If I was Manti's PR guy, I would be begging Letterman to put a Top Ten list together and have Manti come on and read it.
