I just wasn't sure if it was from the day he took the money, or from the day the University was aware he possibly committed a NCAA violation, if they played him,

If he took money and school at time knew nothing about it they do not have to forfeit games. You forfeit games when you knowingly or should have known the player was ineligible.

I am trying to think back to recent examples of selling autographs/memorabilia and you may be correct; Ohio State/Pryor comes to mind.

Either way this allegation would put FSU on notice and they will be forced to sit him now I would think

per espn

Under NCAA rules, Gurley would face a potential one-game suspension (10 percent of the team's competition) if he accepted improper benefits ranging from $100 to $400. The penalty would increase to two games (20 percent) for amounts from $400 to $700, and to four games (30 percent) for amounts greater than $700.

My battered fan syndrome goes as follows:

1) ND loses nail biter with FSU, and Winston plays
2) Winston is suspended rest of season, and FSU tanks
3) ND runs table, finishing with one loss
4) ND left out of playoff because they lost to a team with 3 losses

Undeniably this. Nightmare scenario. And totally plausible.

I've never understood this reasoning (nothing against you) If (big if) ND wins out and wins the National Championship, no one next year is going to say, they won it because they didn't have to beat FSU with Winston.

I think people/media actually do go above and beyond to pick apart ND so I would not put it past people to say that. I don't think the concern would be if we win out and win the National Championship (b/c then we beat two of the top 4 teams in country at the end of the year), I more envision a situation where we beat FSU without Winston and get into the playoff (most certainly b/c we won the rest of our games) and then lost the first game (obviously worse if the game is not competitive)...ND will never hear the end of it and perhaps more importantly will hurt its chances of getting selected to the playoff in future.

ND deserves to go the playoff it is truly one of the best 4 teams in the country. There is no way we will have a clear picture if ND is that good if Winston doesn't play. FSU - Winston = Clemson; would be a tough game but we would probably expect to win. The schedule has turned out to be much softer than anticipated, I think ND needs to beat FSU at full strength to be legitimately considered a top 4 team.

Why did he need to steal crablegs if he had all that autograph cash? Must not have been thinking clearly after the rape. This kid is a bad seed.

I'll skip the bravado of beating FSU with Winston and prefer to play them while he's on the sidelines. This guy has been under the microscope since the get go... where there is smoke there's fire. Hell probably cost FSU last years title and all of this years games over one of his incidents. As someone earlier said, would really suck if ND goes 11-1 and misses the playoffs only to find out down the road that he shouldn't have been able to play. Hope he finally gets the book thrown at him, he's nothing more than a Teflon Con.

I watched 420 hours of FSU film this morning and truly BELIEVE...that by beating FSU at full strength, would make ND the best team EVER!!! Ron Jaworski

Give him credit: he did manage to get the "integrity" clause removed from the Heismam award.

Florida State Seminoles quarterback Jameis Winston facing disciplinary hearing - ESPN

Updated: October 10, 2014, 10:11 PM ET
By Mark Schlabach | ESPN.com

N.B. This appears to current

Florida State officials notified reigning Heisman Trophy winner Jameis Winston on Friday that he will face a disciplinary hearing into charges about whether he sexually assaulted an FSU student in December 2012.

In a letter sent to Winston and his attorney on Friday, FSU interim president Garnett Stokes and vice president for student affairs Mary B. Coburn notified Winston that he might be charged with as many as four violations of FSU's student conduct code, two of which involve sexual conduct.

According to FSU's student conduct policy, Winston has five school days to contact the school's Office of Student Rights and Responsibilities to schedule an information hearing, in which he will be advised about his rights and the upcoming student conduct hearing. The student conduct hearing would be held as soon as possible after the informational hearing and would determine whether or not Winston is charged.

FSU officials have informed Winston that they have identified three individuals from outside the university who are willing to hear the case. Winston and his accuser will each have an opportunity to strike one of the people from hearing the case.

"It's a highly unusual process and the decision to avoid making a charging decision is a way to get around making a determination about interim football suspensions," said John Clune, the Vail, Colorado-based attorney representing Winston's accuser.

The information in the letter sent to Winston contradicts what his attorney, David Cornwell of Atlanta, tweeted on Friday night:

Florida State is currently under investigation by the Department of Education's Office of Civil Rights, which is trying to determine whether the university properly protected the woman's Title IX rights when she accused Winston of sexually assaulting her on Dec. 7, 2012.

In December 2013, Willie Meggs, the state's district attorney in Tallahassee, declined to pursue criminal charges against Winston after a three-week investigation.

Winston, who led Florida State to a 14-0 record and the BCS national championship last season, is expected to play for the Seminoles in Saturday's game at Syracuse.

Winston and FSU officials couldn't immediately be reached for comment.

I could be wrong but I though Vice President for student affairs Mary B. Coburn was involved in meeting with other FSU officials on dealing (or not dealing) with this situation. Now FSU plays Pontius Pilate and passes the decision to an outside party which has no authority for student conduct or legal matters.

Hope not. We need a feet to the fire prime time game on the road to show us what we are really made of. Not that FSU turns into a cupcake without JW.

Fuck that. If we are 12-0 its irrelevant. Take the win however you can get it.

Her attorney is 100% right about this being a stall tactic so they don't have to hold him out of football, IMO.

All this stuff is going to snowball on FSU in a bad way.
