Why would Utah want to negotiate? I'm not saying you would know the answer to that question, but if the leadership at ND thought that negotiating the buyout was a given, that's a really dumb assumption to make. Utah has zero incentive to back off the buyout number. They created the details of the contract to ensure they would be able to hold onto their guy. Sure, maybe offering a home and home or a Shamrock game at Utah might have been possible, but again, that's not something that should have been assumed.It makes much more sense if ND was not surprised by the buyout, but rather surprised by Utah’s unwillingness to negotiate.

Except they actually couldn't find a deal and they didn't find a way to finish, and again, there was actually no reason to assume there was any negotiation to be made regardless of what normally happens. Utah is facing no repercussions for saying no to any compromise. The same can not be said about ND for assuming there would be room to negotiate (if that's what happened). If it happened this way it was really, really dumb for ND to think a compromise could be made without knowing for sure. It doesn't matter if lawyers do this stuff all the time.
