Not what I was expecting when I logged in this morning.
Per SBT write Mary Kate Malone, Carlo allegedly told officers:
One officer reported he was kneed in the abdomen by Rees, which knocked the wind out of him and made him pepper spray Tommy. Tommy continued to resist after handcuffed.
All sounds bad.
You watch too many movies. A warrant is needed to search, if a cop sees a crime happen he can enter.
I have not seen 1 post with the correct story posted in this thread so I feel that some should take a deep breath and go about your day.

Rees, standing about 10 feet from the officers, threw a bottle at one of the officers. The bottle sailed about 15 feet over the officer's head and landed harmlessly. Calabrese attempted to tackle one of the officers, but was quickly shoved face first to the ground. Brian Kelly had no offcical comment, but was said to be very red faced over the incident.
Clarification: Apparently "kneed" the officer, has now been amended to "lifted a knee to the officer", while on the ground in custody.

I fail to see where you are disagreeing with me. My point is that if I'm twenty, and I'm drinking on my front yard, and an officer rolls up, a can and should go inside and shut the door. He doesn't have the ability to claim reasonable suspicion or plain view just for seeing someone drink a beer. Obviously, if someone is having a completely ridiculous "American Pie" style party, or if I'm twelve and I look like it then it's different. So my point was, if I'm twenty and I don't look young, and a police officer without a warrant tells me to open my door because he believes that he has evidence of a plain view or exigent circumstances, I'll roll the dice and let him break down the door, which puts me in a hell of a better legal position than giving him consent to search.

Eh.. When I was a freshman in college I witnessed a 300 lb cop trying to handcuff a drunk 120 lb kid at a party and after the kid wiggled away from his fat *** he charged him with assaulting an officer and resisting arrest. Not saying this is what happened but I'll wait until all the facts are in before judging this.
