Per SBT write Mary Kate Malone, Carlo allegedly told officers:



One officer reported he was kneed in the abdomen by Rees, which knocked the wind out of him and made him pepper spray Tommy. Tommy continued to resist after handcuffed.

All sounds bad.

"My people" has to mean Polish Maffia

Clarification: Apparently "kneed" the officer, has now been amended to "lifted a knee to the officer", while on the ground in custody.

You watch too many movies. A warrant is needed to search, if a cop sees a crime happen he can enter.

I fail to see where you are disagreeing with me. My point is that if I'm twenty, and I'm drinking on my front yard, and an officer rolls up, a can and should go inside and shut the door. He doesn't have the ability to claim reasonable suspicion or plain view just for seeing someone drink a beer. Obviously, if someone is having a completely ridiculous "American Pie" style party, or if I'm twelve and I look like it then it's different. So my point was, if I'm twenty and I don't look young, and a police officer without a warrant tells me to open my door because he believes that he has evidence of a plain view or exigent circumstances, I'll roll the dice and let him break down the door, which puts me in a hell of a better legal position than giving him consent to search.

Rees, standing about 10 feet from the officers, threw a bottle at one of the officers. The bottle sailed about 15 feet over the officer's head and landed harmlessly. Calabrese attempted to tackle one of the officers, but was quickly shoved face first to the ground. Brian Kelly had no offcical comment, but was said to be very red faced over the incident.

Saw on Rivals. Had to laugh a little.


Dumb, dumb decision. Hopefully they are able to straighten things out longterm.

Yeah, which I'm guessing should actually be amended to "might have squirmed a little bit while in custody on the ground."

To bad it doesn't matter since he knocked the wind out of him that is where the battery come in to play.

Yeah, because the police officer may sue Rees for damages.

Eh.. When I was a freshman in college I witnessed a 300 lb cop trying to handcuff a drunk 120 lb kid at a party and after the kid wiggled away from his fat *** he charged him with assaulting an officer and resisting arrest. Not saying this is what happened but I'll wait until all the facts are in before judging this.

I am obviously bias to any form of resisting arrest due to my profession, however there is a major difference to passively and actively resisting arrest. The situation you a talking about is nothing more than a misdemeanor in the state of Georgia, but when someone takes resisting to the point of punching and kicking that does constitute a felony. I am not going to jump to conclusions in Tommy's case untill all the facts come out because I have been on several scene before where the arresting officer have did write the felony charge for any level of resisting just because he or she could, which is bull**** IMO. I hope for Tommy's sake what is being said is not true because felony assault on a police officer is a sure fire way to destroy a future.

This is definitely bringing out the idiots in our fan base. What Tommy is accused of is terrible. No doubt. The fact that any of our fans could be remotely happy about this situation is a totally f'ed. I can't even wrap my head around it.

Meh, if we are talking about black eyes...why weren't we calling for Floyd's head?! Let's be real with ourselves...I don't believe anyone is saying we should be pitying Rees...both sides realize that he should be punished for his actions. However, if Tommy performed like Jimmy...not a single one of you would be doing a happy dance and that's what i feel is wrong. I have been calling for a new QB for over a year now, but my only concern is that this young man gets a 2nd chance with the university, even if that means he never plays another down for the football team...That is all.

Maybe I'm out of line, but I hope this opens the door wide open for Golson/Keil (not feeling Hendrix as a full time passer. I can't see good things with him whizzing it around the field 25 times a game. He's got an arm like that kid on the movie 'rookie of the year').

I hope one of the young guy gets his chance and never looks back. Not good for Tommy and wouldn't wish this on anyone, but if he's suspended for at least one game, this could be the best thing that happens to ND football.

Wrong. I was arrested in high school for MIP and contributing to a minor (yes, I was a minor as well at the time) there were 5 of us in the kitchen (which had a window to the back yard that you could see through from the street) Cop walked up, shined his light in the window and let himself in the gate and started checking ID's.....Had no idea how old we were and two of my buddies had full grown beards. So throw that crap out the window about "looking young"...that doesn't apply whatsoever. Usually they won't mess with those that they think are old enough...but it's not a rule.

Doesn't matter what you look like. If they suspect minors are drinking, they can enter your house. Reasonable suspicion.

Cops can ask for ID at anytime they suspect anything.

Here's some interesting tidbits to the situation:

The new South Bend Chief of Police is Chuck Hurley. Hurley was fired by Notre Dame for his role in the Dave Duerson incident. Hurley sued Notre Dame and won in court.

Also: The new Mayor of South Bend's father is a Notre Dame professor.

South Bend/Notre Dame is an interesting mixture that is always changing.
