Anyone following this closely saw this coming, so a little anti-climatic. But it is good to see the man exonerated because he clearly did nothing wrong.

Or, he clearly wasn't subject to penalty for his wrong doing under the CBA.

Actually, I think it is the opposite. Because they aren't beholden to the whims of the public and they don't report to a "boss," they are freed to decide disputes objectively and without influence. That is like the whole theory of not having judges subject to elections.

OJ was innocent until proven guilty. Brady was guilty until proven innocent (as the default is to give deference to the arbitrator).

I just read a quick summary and the decision was based on the process (notice, etc..) not the facts as alleged in the Wells Report. So this has nothing to do with innocence or guilt.

It does not. However, he would have had an ever better chance of winning if this trial had been about the Wells Report instead of the arbitration process.

It was certainly couched that way. It had to be to withstand appellate review. If you read the transcripts of the hearings, I think you will find that the judge had serious concerns about the merits of the NFL's case against Brady on a factual basis.

You are one of the big legal guys on here right? So how can you post this? As in many cases, we do not know for sure that "he clearly did nothing wrong", we only know what has come out. Since when do you believe that everything about any case has come out. He may well be completely innocent, but that is not something someone in the general public can KNOW for certain as we have not been around him every second of every day. We can KNOW that he is clearly guilty if there is direct evidence released showing he is.

Happy for you that you are happy about this, but I am curious.

good point. Colts are going to get slaughtered IMO. They haven't been competitive with the Pats under Luck in all 4 match ups.

Remember after Spygate when Brady came out and destroyed the entire NFL? He's not a guy you want to give extra motivation to. Colts gave him a shit-ton of extra motivation. I'm gonna say Pats by 30.

I agree. I think most of New England is expecting Brady/Belichick to be fully in eff-you mode the whole season.

This has been an enjoyable thread and I'm glad I kept up with it. Between the posts here from Pats fans and articles from Yahoo/other outlets, it was pretty clear the NFL screwed this up big time.

If the NFL wins that one, it's possible Brady's suspension could be reinstated where he could possibly miss the last three regular season games and the first playoff game.

Average appeal in this case takes 10 months. I'd be shocked if any decision came down before the end of the playoffs. I may be wrong, but I also believe that they would have to overrule each of Berman's three main points.

1) no warning for penalty
2) no Pash at the original appeal
3) hiding evidence behind confidentiality agreement

It seems pretty ironclad to me, but I am obviously biased. He will be out there Week 6 in Indy either way

Nobody loses and doesn't appeal. The NFL was expected to appeal. They will not win their appeal, but everyone is entitled to bring an appeal, so everyone does whether they will win or not.

As far as an expedited hearing, they can ask for one. But the only reason one was granted in this case is because the parties agreed. The NFLPA will obviously not agree to an expedited process for an appeal, and an appellate court is far less likely to agree to that anyways.

The NFL should have put in most of its work in preparing its appeal brief already, but before it read Judge Berman's decision they couldn't have had it ready to go. So they will need some time to file their appeal, then the NFLPA will have a significant amount of time to file their Respondent's brief. Then there could potentially be additional filings, then they have to get on the calendar for oral arguments, then they will likely have to do another round of filings, then they will get on another calendar for when the court's decision will be published. Typically, an appeal takes many months, sometimes many years. If you are waiting for an appeals court to reinstate the NFL's discipline, I wouldn't count on hearing something in 3 or 4 weeks.
