NEW ORLEANS -- An Alabama fan has been charged with sexual battery after authorities say he was captured on video performing a simulated sex act on an unconscious LSU fan after the BCS Championship Game.

An Orleans Parish grand jury on Thursday handed up an indictment against 32-year-old Brian H. Downing. It charges him with one count each of sexual battery of a male victim and obscenity.

A video that went viral on the Internet is believed to have been taken at a fast-food restaurant in New Orleans after Alabama defeated LSU on Jan. 9.

A man wearing Crimson Tide attire appears to be performing the simulated act on the LSU fan. Authorities say that was Downing of Smiths Station, Ala.

The court set bond at $50,000.

Keep that in mind when somebody drags there genitals across your face. Public place or not.

Indecent was his public exposure. The sexual battery commenced from there. He should be a registered sex offender.

He could have gotten up to 10 years but ACCEPTED a plea bargain his lawyer negotiated.

Yeah sorry but I agree with BGIF. It's easy for us to say "Man that guy got screwed" but imagine being a college kid and being instantly recognized by all your classmates, family, friends, coworkers, and lady-friends as the guy who is nationally famous for getting balls rubbed on your face. It was a disgusting act, and the offender is really lucky to get out with only two years.

(Also there is the cliche, but true, "imagine if it was a girl getting tea bagged while passed out." Changes the perspective somewhat.)

That show is hilarious, if any of your lady friends insist you take them to a broadway show, agree to this one... Side splittingly funny.
I saw it when the red-head guy from Modern Family was on it, I think that got him the part.

Agree to disagree I guess. It was a harmless prank. I've watched the video and don't know the victim's name, what he looks like (other than purple and gold) or anything about him. It doesn't change anything if he's recognized for it, either. Get a restraining order and maybe some compensation and call it a day. I agree that he should be a registered sex offender but his life is ruined over something that literally affects nobody. Everyone was going to forget about it in a week anyway, this only serves to drag it out and keep bringing up the video.

If it were a girl, it would be an act of a sexual nature. This wasn't.

I'm of the opinion that there should be an amendment to our Constitution making it permissible for a drunk, passed out LSU fan to be teabagged by a drunk Alabama fan, anytime anywhere. And vice versa.
