A company like that will probably require a drug and alcohol screen for the employee as soon as they're made aware of the incident.

I've deleted your post from my reply and recommend you do the same. Some of your language in the original post could be used against you, and particularly the post just above this one. You'll be amazed how creatively. You may think any chance of them finding you on this site is slight but you were having a conversion about your personal Twitter on here earlier today.

Assuming he is technically an employee, which it sounds like he probably is, you should approach Comcast for a settlement. Whether you have an attorney or not, tell them you'll speak to yours after their first offer.

So my wife was just in an accident in which the other driver was 100% at fault. She was driving about 10 MPH through a construction zone when he pulled out of an adjacent parking lot and smashed her on the side of her rear bumper. They exchanged insurance information but then he ran off when he learned she called the police. My wife smelled liquor on his breath and the police are out searching for him now. He was driving a Comcast Xfinity truck. No physical injuries are immediately apparent but my wife is extremely shaken up. Is it worth pursuing legal action? I'm not a litigious person but "drunk guy hits-and-runs pregnant lady and toddler with his work vehicle" seems like the appropriate time for a lawsuit if there ever is one.

Just curious, what exactly would you be suing for? Vehicle damage? Emotional stress? To prevent this guy from doing it again? All of the above?

Obviously you need to do what's right for your family but if my wife and kids were fine (I hope yours are) I probably would let it go, beyond getting property damage. Seems like a much more stressful endeavor going through litigation but I typically aim for a more stress free lifestyle than you corporate guys :)

I had something similar years ago. Regardless of what your wife told the policeman, proving he was under the influence or legally drunk would be impossible at this time. I would press Comcast to pay for the repairs so you don't have to claim it under your insurance and possibly effect your rates.

My past experience and given there are no injuries, if you use an attorney, they may want money up front for the number of hours they believe it will take. Then Comcast will go back and forth and you may need to shell out some more to the attorney, so make sure any settlement is worth the time and money spent.
