If this was not on campus, this should be a non-factor other than the fact that he'll now be under the microscope by res-life.

In reply to a couple of the above posts:

According to du Lac, the Student Handbook, possession of controlled substances including marijuana and driving while impaired/intoxicated, etc. are viewed as much more serious violations with prescribed disciplinary measures.

Under age consumption of alcohol is a violation of res life policy but without intoxication or other serious aggravating factors there is not a prescribed punishment that I can see. It does not make a distinction between consumption on or off campus.

It would seem that with a first offense and no aggravating factors, discipline from Res Life would be relatively light.

If I were #3, I would be more worried about the rath of BK right now.

i fully expect BK to handle this the right way. the team will fully understand his position on such matters!

I'm guessing BK is going to lay the smack down.

Floyd is going to learn from this and hopefully be more focused for the team now.

I don't see how Res Life, ND, ND football, or Kelly has anything to do with this at all. He was in a different city in a different state. Was not at all school related. Seems to me it's up to the local judge to dole out the fine, then everyone moves on. To think he would lose any playing time or practice time over this is ridiculous. Had nothing to do with a football game or the U of ND.

word up, you beat me to it.

When did you people start following ND football, last week?

PapaIrish seems to be the only one here with an inkling of Notre Dame student life.

It doens't matter if you got drunk daily or if you got laid in the dean's office wherever you went to college. If doens't matter what you think is right or wrong. This is Notre Dame. Floyd is bound by du lac as are all students at ND.

This isn't a new concept. It was discussed at length during each of Yeatman's busts and suspensions.

Being of campus or out of state has no bearing. ND considers you a student 24/7 regardless of your location. None of you remember Powers-Neal? Do you remember why he got suspended for a season? It wasn't Weis - ot was ResLife. He didn't get arrested in South Bend. He was back home in Minnesota.

Anyone remember John Cerasani? He was a TE. Roughly the same time period (month) back in '97. He was in a South Bend bar. A teammate was ragging his ass about his mother's health. She had a terminal illness was bedridden. Friends talked him into walking away. He did. But then he went back in and clocked the guy. Police got involved. Alcohol and a fight.

Cerasani's ResLife hearing didn't take place until the following semester. When Spring Pratice started the decision had not been rendered and he was practicing with the team. ResLife suspended him from Student Activities for a semester. That's typiclal across the board. The coach doesn't suspend you ResLife does whether your an All-American WR, a cheerleader, or on the chess team.

Oh yeah, ResLIfe didn't suspend Cerasani from Spring Ball he was suspended for the FOLLOWING semester, Football Season. A South Bend Tribune writer noted that had Cerasani punched his teammate in the jaw during a practice session he probably would have gotten an "Attaboy!" from his coaches. But since he did it in public with alcohol, he was toast.

Cerasani asked for the suspension to be carried out immediately that Spring or postponed to the following Spring. He was entering his Senior season and he requested that his mother see him one more time playing for ND as she was terminal. He transferred to Northwestern right after his request for delay of suspension was denied.

Think this is new? It is't. bout 20 years All-America LB Micheal Stonebreaker was injured severaly in a automobile accident. Back on campus a friend or roommate's car was about to get ticketed for some parking infraction. Stonebreaker moved the car before it got ticketed. Only problem was he didn't have a driver's license. It was revoked for the DUI. Campus police issued Stonie a ticket for no license. ResLife suspended him for driving without a license.

A couple of years ago there was a ND female swimmer or diver that got busted in Mexico (It might have also been a DUI, I'm not sure). Point was, she claimed ND had no jurisdiction over her out of the country. She lost. As a student you agree to the terms of du lac so you are bound by them.

I would not be surprised if Floyd gets to sit out the '10 season based upon past practices.

I doubt that Floyd will receive that harsh of punishment. I know of plenty of examples of similar situations. In fact, I was cited for underage drinking while at ND. I did have to appear in front of Res Life, but all I got was a slap on the wrist. I don't know if the rules have become much more strict in the 6 years that I have been gone, but I don't think he will miss any of the season.

And what did they say about your underage fighting while drinking?

My bad BGIF. I didn't read the article. I just read the responses. If there was a fight involved then all bets are off. It will depend on what charges stem from the incident.

Jesus Christ. He could be in some trouble. What is he doing fighting? With his name a cop would love to arrest him. I'm sure whatever happened wasn't serious enough to fight about. And if hes going to do this shit, at least do it in a place where he wont get caught. Also, as long as he wasn't fall on his face drunk he could have denied drinking anything and the cops wouldn't have been able to prove it. (given he wasn't driving).

RPN did it in the middle of the season and was suspended the rest of the season after the 4th game, he was charged with a dui also, not underage drinking, no way he is suspended for the season.

ResLife is pretty much equivocal to Salem Witch Trials. If you are summoned, expect the worse and just take it. You signed the agreement with DuLac and that is the only justification they need. My girlfriend was a resident advisor and she told me that when she was doing her training, her advisors (nuns) told them to avoid involving Reslife as much as possible. From my past experiences there and from my girlfriend, situations that happen on campus are punished far worse than off-campus ones. I would imagine he will be required to go to a few AA meetings but I do not think he will be suspended.

This stuff happens, I think some time out in the Spring maybe, but next fall would be excessive in my opinion.

Wow.

Michael is better. At least he was up front and honest with the cops.

Michael made a mistake and was classy enough to acknowledge it.
I don't think he sure get any sort of severe punishment from the law anyway.

BK will probably make an example out of him. That way other players don't mess up too.

Res Life is something all students, not just athletes are made very aware of at the beginning of Freshman year. That said, there is precedent for first offense with alcohol to not bring much more than a don't do that again (e.g., see M. Golic, Jr.). Subsequent offenses, DUI or DWI, or use of controlled substances seems to be dealt with much more harshly even with a first offense.

The wild card here is the "fight." I haven't seen more details about this but that would seem to be the one thing that would worry me about the incident. Violence and alcohol could raise the ante.

The good Fathers, most of the faculty and much of the student body believe it when they say "We are ND." It is the same whether you are on campus, on the town or anywhere around the world. The nature of the place and the responsibility that goes with the privelege of being a part of it goes with you.

As much as it may make it more difficult to field NC teams, it is one of the things that makes Our Lady's University different in the both the world of big time academic institutions and big time college sports. Mr. Kelly seems to have bought in when he talks about the whole community being able to be proud of the gentlemen who will be suiting up for us on Saturdays.

I hope #3 was in self defense mode and he won't get more than a minor punishment from the Res Life gang. I still think BK is the one he needs to worry about more.

Don't know if this point was made earlier, but remember Clausen had a few problems with alcohol and being caught. With that being said, I think this is a non-story as a football fan even though the school and program must punish him somehow.
