I hope they just obliterate the program now. Not just a "X years" death penalty, but like completely and totally donezo. How could a community be so incredibly myopic and tone deaf?

This. To the Penn State faithful, the trustees are heroes. To the rest of the country, the delusional board is up there with the Paterno family in teaching the rest of us lessons on how to make a pile of sh!t smell even worse and stand even higher.

I hope that the BOT does file a suit in federal court. That way all those who refused to talk to the Freeh investigators will be placed under oath and forced to answer. That might include all the uppity ups at PU and 2nd mile, the state attorney at the time no charges were filed, who is now governor of the state, and many, if not most, of the BOT. They might even look into the mysterious disappearance of the prosecutor who was investigating this mess a few years ago.
And all those who are clamoring for "do process" will get it in spades. When they get real due process, they will regret it.

Maybe someone else has a different legal opinion from my own, but it seems to me that the NCAA has little to worry about here. The NCAA acted on the belief that Erickson was acting on authority granted by the BoT. Even if he didn't have that authority, the NCAA reasonably believed he did under apparent authority in agency theory. If the BoT or players have a gripe, it is with Erickson, not the NCAA.

As far as Paterno goes, dead people can't be defamed--this is settled case law. And estates cannot sue for defamation on behalf of the decedent, which is what the family would seem to desire so they can continue to profit on the Joe Paterno name.

As for the recently announced player's appeal, they were not even "involved individuals" and have even less of a claim for standing than the BoT members or Paterno's family.

I have a feeling their offense 3-4 years down the road will be Hackenberg feeding Breneman on nearly every play. Which might work considering that's what O'Brien did with the Pats.

I still dont think those two will be signing with PSU on NSD. Maybe Breneman because the injury might have scared some people away, but I personally think both will decommit eventually.
