I think the punishment was a little harsh for the crime. A month for the bird?
I've got mixed emotions. The clip isn't continuous so we don't have a complete picture.
I thought his doubling the bail was harsh. He was flippant with his "bye bye". He then took umbrage when she responded "adios" so he doubled her bail. Considering both the judge is of hispanic descent and the arraigned is also and we live in a land where you have to "press 1 if you wish to speak English ..." that response doesn't seem contemptuous.
She blows up when the bail is doubled, flips the bird, and added a command for the judge to commit an anatomically impossible act. That's when he hit her with 30 days.
Under FL Rule of Criminal Procedure 3.830 Direct Criminal Contempt, she did show contempt in open court and if I read correctly could be sentenced up to 12 months. 3.830 requires the judge give the individual the opportunity to respond/ offer a mitigating explanation. That doesn't appear in the clip but that doesn't mean it didn't take place. We don't know.
We also don't know whether she had counsel, it didn't appear so. I would think a decent attorney has some wiggle room here. Nonetheless she was stupid whether she was under the influence or not.
