the part I have issue with is "I'm not going to stand in the way of that."... and if you don't see how that may raise an eye brow after the previous segments of his statement then I don't know what to tell you... not that hard. Maybe it's because I'm not a conspiracy buff but it strikes me as very straight forward.
Kelly helped Wenger pursue a 6th year waiver from the NCAA in the belief that his medical condition would improve/no longer be an issue. But after several months of the off season to further evaluate Wenger
the ND medical team said he's a no go.
The ND medical staff says Wenger has a career ending injury.
Wenger disagrees. Maybe he found a doctor with a different opinion but that doesn't matter. HIS doctor doesn't make the medical evaluation on who's fit to play.
Kelly met with Dan and with his parents. He didn't have to either. He could have simply said, like he said to the 5th year candidates that were denied, "Sorry, we don't have room".
With the news coming just before Spring Ball starts it strikes me that they were giving him to the last moment to show his medical history was no longer an issue. Why go to the bother of the 6th year application process, continued medical evaluation, meeting with the player and parents if was simply a space problem?
If this was the Rockne era Wenger might have been told to take two aspirin and get some bed rest. The medical community knows vastly more about head trauma today than they did then. But there's still much to learn. He had played with today's helmets Dave Duerson might still be alive. His cumulative trauma started in high school, contined in college and peaked in the NFL.
I'll conjecture that Dave Duerson had some impact (along with a lot of medical data) on the decision. Declan Sullivan may have had more.
Two months ago Father Jenkins issued an open letter to the ND community where he mourned the loss of a student and noted ND had failed to protect one of their own that was in their care.
There is no greater sadness for a university community than the death of one of its students under any circumstances. Yet this loss is more devastating, for Declan died in a tragic accident while in our care. For that, I am profoundly sorry. ... Declan Sullivan was entrusted to our care, and we failed to keep him safe. We at Notre Dame — and ultimately I, as President — are responsible.
ND has acted responsibly with Dan Wenger.
Dan wants to keep playing. Don't we all? What's Kelly to do block his transfer to Florida? If his parents aren't standing in his way how is Kelly supposed to? Kelly did stand in his way and Wenger has chosen to go around him. That's his perogative. Dan's 21 and a college graduate. He's a man and as such he has chosen to take himself outside ND's care.
Kelly could block a transfer tro a specific school the NCAA allows that but Kelly can't block a transfer to everywhere. As an graduate student Wenger can transfer without sitting out a year. He's free to go anywhere and he's chosen to go elsewhere.

Contrary to the comments of one or two (not you Aaron) posters making uninformed assumptions, Wenger does not have clearance from the Florida medical staff. This isn't the NFL. Wherever he transfers, he still has to pass a physical.
A sports medicine physician I spoke to doubts that any school's medical staff would give a green light on a head trauma history where another medical staff has said no. He noted the new school would be responsible for the evaluation and risk assessment not a family's second opinion physician. He wasn't speaking as one familiar with the case but one familiar with the world of college sports medicine.
