Yes, it should be up to the administration. That depends on resources, which side of the bed the decision maker woke up on that day, is this a hot latina or some fat filipino guy, etc.
If you want to ask more and more specific things you'll get more specific answers. Thats not moving goalposts. Convictions certainly make things more black/white but it doesn't really matter to me.
Frankly it should not even be limited to criminal charges. These people don't have a right to be here. We don't have to let them stay. If the administration thinks some 30 year old foreign doctoral student is a commie, send him back lol.
