I have been reading the book "Signing Day" about the recruitment of a few prospects from a few years ago, Darius Walker being one of those.
I have been reading about his recruitment and came across a story about Walker winning a lawsuit against AMC movie theaters. Did anyone know about this? Walker has $3 Million in the bank from this.
Date: 5/27/2003
Case Style: Laverne Walker, as next of friend of and natural guardian of Darius Walker v. American Multi-Cinema, Inc., AMC Colonial 18 Theaters Inc., and Kevin B. Kellas, individually and in his official capacity.
Case Number: 00VS004833B
Judge: Unknown
Court: State Court, Fulton County, Georgia
Plaintiff's Attorney:
Peter A. Law, Peter A. Law, P.C., Atlanta, Georgia
Defendant's Attorney:
Henry E. Scrudder, Jr. and Aaron J. Aberson, Goldner, Sommers, Scrudder & Bass LLP, Atlanta, Georgia for AMC
Edgar S. Mangiafico, Jr., Duncan & Mangiafico, Atlanta, Georgia
Description: On March 5, 1999, Darius Walker, a minor, was an invitee at an AMC movie theater in Lawrenceville, Georgia. On said date, Darius Walker had paid for and viewed a movie with his friends. Thereafter, Darius called his mother to pick him up from the front of the theater. At that time, Darius was the only black person standing among many white people at the front of the movie theater. While waiting for his mother at the aforementioned AMC theater, Defendant Kevin B. Kellas approached Darius Walker and ordered him to leave the AMC premises. Although Darius Walker attempted to explain that he was waiting for his mother, Kellas became very forceful and threatened Plaintiff. Thereafter, Defendant Kellas forcibly struck, touched and assaulted Plaintiff in an effort to prevent Darius Walker from “loitering” at Defendant AMC’s property and in order to enforce AMC’s policies and procedures. Defendants thereafter unlawfully detained and arrested Darius Walker without probable cause and with malice. After Defendants initial unlawful use of force, detention and arrest, Defendants thereafter pursued a malicious prosecution against Darius Walker. Thereafter, said prosecution was terminated favorably to Darius Walker. Plaintiffs contend Defendants’ intentional touching of Darius Walker was done without necessity, privilege, or consent. Defendant Kellas and AMC held Darius Walker against his will and committed all of the offensive conduct without the consent of Darius Walker and against his will and desire. At all times mentioned herein, Defendant Kellas was employed as security personnel and as an employee at Defendant AMC’s movie theatre and Defendant Kellas was acting as an agent and employee of Defendant AMC. Defendant AMC hired, employed, and retained Defendant Kellas as an employee when it knew, or reasonably should have known, that Defendant Kellas was dangerous and had a propensity to use excessive force against persons. Similar assaults and attacks were committed against members of the public at the AMC property by Defendant Kellas prior to the acts committed against Darius Walker.
Outcome: Plaintiff's verdict for 3.002 million.
Plaintiff's Experts: Unknown
Defendant's Experts: Unknown
Comments: The demand before trial was $300,000.00.
