I have been reading the book "Signing Day" about the recruitment of a few prospects from a few years ago, Darius Walker being one of those.

I have been reading about his recruitment and came across a story about Walker winning a lawsuit against AMC movie theaters. Did anyone know about this? Walker has $3 Million in the bank from this.

Date: 5/27/2003

Case Style: Laverne Walker, as next of friend of and natural guardian of Darius Walker v. American Multi-Cinema, Inc., AMC Colonial 18 Theaters Inc., and Kevin B. Kellas, individually and in his official capacity.

Case Number: 00VS004833B

Judge: Unknown

Court: State Court, Fulton County, Georgia

Plaintiff's Attorney:

Peter A. Law, Peter A. Law, P.C., Atlanta, Georgia

Defendant's Attorney:

Henry E. Scrudder, Jr. and Aaron J. Aberson, Goldner, Sommers, Scrudder & Bass LLP, Atlanta, Georgia for AMC

Edgar S. Mangiafico, Jr., Duncan & Mangiafico, Atlanta, Georgia

Description: On March 5, 1999, Darius Walker, a minor, was an invitee at an AMC movie theater in Lawrenceville, Georgia. On said date, Darius Walker had paid for and viewed a movie with his friends. Thereafter, Darius called his mother to pick him up from the front of the theater. At that time, Darius was the only black person standing among many white people at the front of the movie theater. While waiting for his mother at the aforementioned AMC theater, Defendant Kevin B. Kellas approached Darius Walker and ordered him to leave the AMC premises. Although Darius Walker attempted to explain that he was waiting for his mother, Kellas became very forceful and threatened Plaintiff. Thereafter, Defendant Kellas forcibly struck, touched and assaulted Plaintiff in an effort to prevent Darius Walker from “loitering” at Defendant AMC’s property and in order to enforce AMC’s policies and procedures. Defendants thereafter unlawfully detained and arrested Darius Walker without probable cause and with malice. After Defendants initial unlawful use of force, detention and arrest, Defendants thereafter pursued a malicious prosecution against Darius Walker. Thereafter, said prosecution was terminated favorably to Darius Walker. Plaintiffs contend Defendants’ intentional touching of Darius Walker was done without necessity, privilege, or consent. Defendant Kellas and AMC held Darius Walker against his will and committed all of the offensive conduct without the consent of Darius Walker and against his will and desire. At all times mentioned herein, Defendant Kellas was employed as security personnel and as an employee at Defendant AMC’s movie theatre and Defendant Kellas was acting as an agent and employee of Defendant AMC. Defendant AMC hired, employed, and retained Defendant Kellas as an employee when it knew, or reasonably should have known, that Defendant Kellas was dangerous and had a propensity to use excessive force against persons. Similar assaults and attacks were committed against members of the public at the AMC property by Defendant Kellas prior to the acts committed against Darius Walker.

Outcome: Plaintiff's verdict for 3.002 million.

Plaintiff's Experts: Unknown

Defendant's Experts: Unknown

Comments: The demand before trial was $300,000.00.

The movie was over and he was waiting for his mother. The security officer asked him to see his ticket stub. He explained the movie he saw was over, his friends were in the bathroom and he was waiting for his ride. The guy knocked him down and cuffed him, before Walker could present the ticket stub....which he had in his pocket.

The book said he bought a pimped out Benz, but other than that there is no mention of what he did with the money.

Wow. That sucks for Darius that it happened, but I'm glad justice was served.

After he signs his NFL contract, he ought to buy that theater and burn it to the ground. He won't, though. He is a Notre Dame man through and through. They interview his parents all the time. You can see where he gets it from. They're a good family.

He really is. Just reading about him makes you realize that he won't need football later in life. The kid has gotten straight A's since he's been in school. Amazing.

I believe his parents moved to South Bend with him? If not, they're at just about every game. With $3M in the bank and Darius going to school for free, I guess they don't have to do much if they don't want to.

The south is a different place. I have lived in the Northeast pretty much my whole life and I can tell you that some of the things that I hear go on down in the south would never happen in the Northeast.

Yes the south really sucks, Im not originally from Florida. I have been to the the North East and Mid West I grew up in the South West. The South East has to be my least favorite place.
I was wondering how a family can just pick up and move like his family did.

You know, that really pisses me off. It was probably some red-neck, A-Hole making $6.25 an hour walking around with his G.I. Joe wanna be walkie talkie and Dollar Store toy policeman's badge, trying to mess with some young, innocent kid who just put money into his stupid theater. I'm glad that Walker was laughing all the way to the bank, but human beings should not be treated like this.

I would have knocked the snot out of that Barnie Fife wanna be and beat him over the head with a box of Raisinettes.

Way to go Darius.

The authors of Signing Day mentioned that a car in the theater parking lot had been broken into that night.

I'm guessing your theory is correct, IrishND31.

Doesn't it make you sick to think about? I feel for any person who would have to endure such an incident. I guess what don't kill you makes you stronger and Darius is a very strong young man (not only on the football field, but also as a person).

Wow! If this is true than Darius really is a down to earth hardworking individual. With all of that money it's hard to believe that he was working at Hat World over the summer in South Bend.

Its funny you mention that. I used to have a roommate from Atlanta that used to argue w/ me about where the most racism occurs, the north or the south. I hope he saw this story somewhere when it happened.

If this is really how it went down, then Darius deserved every penny he got and then some. And I hope that guy got thrown in jail too for a few years.

His attorney gets 1/3, plus the costs he expended on Darius' behalf. A job well done by that attorney. Especially in the south.

One more thing. How dumb of AMC not to settle for $300,000, KNOWING that Kellas had done similar acts before. Then AMC goes to trial and loses 10 times that amount. Their attorneys are either stupid, arrogant or both. Obviously, a great day for Darius and the American dream.

I went to an AMC here this past weekend and walked out of King Kong about half way through it. First time I'd ever walked out of a movie.

I got the $19 put back on my gift card and I felt like I'd won the Super Bowl.

I should have slipped on some popcorn butter and taken a dive.

That does it! I'm not going to waste my money on King Kong either. Too many bad reviews!

Okay, gotta speak up on that one...

Pennsylvania counts as the Northeast, right? In my college years, I once saw a pickup truck in Pennsylvania, with Pennsylvania plates, and with several confederate flag bumper stickers. Make no mistake, no place is immune to racism.

And yeah, the South is a different place from the Northeast. It's also a different place from what it was 30 years ago. 30 years ago, Darius would still be in jail. Today, he wins a $3 million lawsuit with a Southern judge and a Southern jury in a Southern court, because the vast majority of today's Southerners are sick and tired of jackasses like this security officer who think they're still fighting the War Between The States. But hey, if you'd rather base your opinion of the South on the jackass instead of the normal people who outnumber him, go right ahead. Free country.

Good for Darius. Glad to see he came out on top on this one.

Let me put it to you this way: They filmed most of it in front of a blue screen. It was a lot of special effect nonsense.

We went home and watched Rudy.

Here is a great article by an ND friend of mine who is originally from Irmo SC (we southerners had to stick together while at ND). I really never new how important that was until I read this thread.

Not exactly on point but it does deal with being Catholic in the South and the skeletons we as southerners (no, americans) carry:

I carry Rudy with me and my portable DVD player. Anytime I need a pick me up, I just pop that in and I'm inspired to take on the world. I just gotta stop watching on the freeway!!!

As a native Pennsylvanian and one who has lived in both Philly and Lancaster (Central PA), I think that James Carville said it best. He was managing a Senator's campaign and said you can describe PA this way: "You've got Philly on one side and Pittsburgh on the other and then Alabama in the middle" (no offense to any 'Bamans, remember this was coming from a Ragin' Cajun'). Central PA is VERY scary, seriously cousin marrying country. It is the northern tip of the Appalachians.

Easy fella, check the "Where You At?" map. There are idiots everywhere.

Darius Walker getting handcuffed for standing outside a movie theater while being black - real racism

Ty Willingham getting fired for mediocre coaching - perceived racism.

Woah there guy. As a Pennsylvanian, I will say that i have NEVER considered marrying my cousin. Never. LMAO. I can see what you are getting at though. I am from the suburbs of Cleveland and lived there for over 28 years. I moved out to PA about 3 years ago and it is a completely different scene out here. I can neither confirm nor deny the "cousin marrying" thing, but there are some odd ones out here (just like anywhere you go).

This is why I have no time to be racist. I judge people individually. There are morons in every race, religion and gender. Well said.

The Walker-Willingham analogy was also good.

I'm going to see Glory Road this weekend. It had better be good or else I"m not going back to the theater again. The King Kong debacle really soured me.

don't get it twisted- there are a few northern cities that are just as backwards (in some cases moreso), and just as racially ugly- it is a human problem/cancer- not a geographical one.

I used to go to school in Philadelphia, and the one thing on that that I'll say is, more than once I heard people describe PA as, "It's like New York and Los Angeles, seperated by Alabama." I guess what I'm trying to say is I don't really consder the middle of PA to be a part of like the Northeast/Tri-State Area I live ind (NJ, NY, and Conn area). And I don't think the people from Central PA would either.

No doubt racism exists everywhere though. I do think its a little less obvious in some places though, which certianly is not necessarily a good thing.

Oh, nvm, someone already used that line.

Oh that's for certain. The Red Sox were the last team to racially integrate after Jackie Robinson broke the color barrier. Which means they got beat by ever southern team in existence at the time (there were a few, weren't there? I'm not a baseball historian).

I think it does take different forms in different places though. I don't remember New York every having to have a "Freedom Summer" like the one in Mississippi to ensure minorities the right to vote. But I'm sure it take place in other ways that are a little more nebulous and harder to root out.
