Released today by spokesman:

Notre Dame will never be silent or passive when it comes to the careful, thorough and fair determination of whether or not laws or university policies have been broken on our campus. This is an important obligation and one that we take very seriously. We have a longstanding, effective and consistent process in place that gathers information, eliminates rumors and makes informed, fact-based determinations, all while adhering to university policies and the federal student privacy laws that restrict us from discussing specific disciplinary cases.

In addition, it is important to note that the Notre Dame Security Police Department is a fully authorized police agency that works closely and collaboratively with local law enforcement agencies, including the St. Joseph County Prosecutor's Office. All investigations of sexual assault are forwarded to the prosecutor's office so that action, if warranted, can be taken.

Thanks TT! Just unfortunate the university was put in the position to have to issue a response and that a kid's good name may have been tarnished bc of all this.

Good to see ND finally say something about this situation. I have faith that they will do the right thing, I know that they have before when this same thing happened. Once they get all the facts, it should be taken care of quickly. It just sucks that this is another issue to pile on top of everything else this year.

Maybe now we won't have anything else happen now. We have had our 3 bad things happen. James dies, Declan die, and now this rape ordeal. Hopefully we will have a smooth rest of the year.

I know it may seem like nitpicking, but it was NOT a "rape thing". While any kind of sexual assault is a serious thing, sexual assault could be a wide variety of behaviors that are nowhere near the seriousness of rape.

This is good to see. Lately more than ever there have been to many people trying to portrait this university in a negative way. While some events have been negative, the large amount of speculation and assumptions in a derogatory manor have been over-kill.

while this is an absolutely tragic occurence, it happened before the season even started. why is it surfacing now? it just seems very oddly timed, and very incomplete as well.

I find it very hard to believe that Notre Dame did not do their due diligence with such a matter as this.

Innocent until proven guilty can be added to the list of liberties lost in this country, if it hasn't been already...

Hey all,

Just received this e-mail from ND's Public Affairs VP:

Dear Faculty, Staff and Students,

As I’m sure you have read, the Chicago Tribune has published a story about the tragic death of a Saint Mary’s College student, Lizzy Seeberg.

There is a law in place known as Family Educational Rights and Privacy Act (FERPA), which prohibits universities from publicly discussing specific disciplinary cases. As a consequence, we cannot at this time publicly correct many of the false impressions created by the Tribune story, but suffice it to say as a general matter, any time that an allegation is made that a law or university policy may have been violated, we have a longstanding process in place to learn the facts and eliminate rumors, which leads to a determination of what action – if any – is appropriate to take. At the same time, our police department works closely and collaboratively with local law enforcement agencies, including the St. Joseph County Prosecutor’s Office, which includes officials from the special victims unit. Both the Prosecutor’s Office and the St. Joseph County Police have issued statements correcting some aspects of the Tribune story and affirming the valuable and professional work of our Notre Dame Security Police. You may wish to read today’s South Bend Tribune story for additional information South Bend Tribune: Police knew of assault report.

I also would like to take this opportunity to reiterate Notre Dame’s commitment to address the issue of sexual violence in all of its forms. We actively seek to prevent sexual assault, address unacceptable and/or unlawful behavior when it occurs, provide resources and support for those who have been victimized, and ensure the safety and well-being of every student. For more information about campus resources, please visit www.csap.nd.edu.

It is and always will be a central tenet of Notre Dame’s mission to learn the truth and to act in accordance with it. As you read stories about any matter that involves our careful and thorough process, I urge you not to arrive at any conclusions until all the facts are known. Only through a serious, informed and fair process can justice be served. Such a process will always be our focus.

Sincerely,

Janet M. Botz
Vice President
Office of Public Affairs and Communications

Wonder if the Tribune will print any kind of retraction. It would certainly be the honorable thing to do.

South Bend Tribune: Police knew of assault report

Here's today's even more updated article in the SBT. So apparently the lead detective was told about the assault case but didn't include it in his report on the suicide. So when the St. Joesph County spokesman didn't see any mention of the assault in their report they figured they weren't notified.

Talk about hack journalism by the Chicago Tribune. I'm glad that rag is going out of business.

This story isn't going away though, it's linked on the front page of Huffingtonpost today, which goes to a story on Politicsdaily, which essentially demands that the player be suspended, if not tarred and feathered and driven out of town.

Without some proof of the alleged assault this whole ordeal is nothing but a major distraction, and hack journalism on the part of a paper that's bankrupt - both financially and morally.
