Rape charges dropped on Duke players

DURHAM, N.C. - Prosecutors dropped rape charges Friday against three Duke University lacrosse players accused of attacking a stripper at a team party, but the three still face kidnapping and sexual offense charges.

According to court papers filed Friday by District Attorney Mike Nifong, the accuser told a prosecution investigator on Thursday that she now does not know if she was penetrated during the alleged attack.

I can't believe this thing is still dragging out. It's a crock of shit and Nifong is a sleaze ball if I've ever seen one.

I can't wait for those kid's and their families to turn around and sue that a**hole for putting them through what they went through and ruin this guy's career and get him disbarred.

Shameless what he did just for his own political gain.

I think Duke should sue the city too. Didn't they cancel the rest of their season because of this scandal?

Maybe they could make the DA the equipment manger for the Lacrosse team for next year?

Yeah, I'm sure Duke wants to sue to defend their good name.

The alledged event didn't happen at a campus tea party.

"Yes, your Honor, they were drunk. Yes, your Honor there were strippers but no Dukies raped anybody. Well, not this time, you Honor."

If Duke sues their campus rape statistics become the daily headline.

If I recall didn't the LAX team have a reputation before this incident?

Do you really think Duke cares to revisit that history in defending it's "good name"?

Duke chose to cancel the team's season. Where are the legal damages?

I highly doubt Duke will be suing anyone. It will be the players and their families whose names have been dragged through the mud for apparently no reason. The Duke lacrosse team's reputation for drinking and partying does not mean they are rapists. Alcohol and strippers doesn't mean any rape occurred by any means.. plus at least 2 of the kids have a solid alibi (the third lived in the house so I don't believe he has one).

It's still going to be dragged out for a while. The DA is still pressing charges of 1st deg. Kidnapping, and 1st deg. Sexual Assault. The legal analysts that I've heard comment on it said that the DA probably waited to release the info untill today (The Fri. afternnon before Christmas) to try to minimize the damage.

My post above has your full quote. That's what I responded to and the only thing I responded to - Duke, and what would be brought up if they sued.

ND has a historical policy regarding no premarital sex but Joe Moore's attorney did a sweet job of getting oral sex introduced into a termination lawsuit, didn't he?

Duke feels enough embarrassment without opening the door by inviting more through a lawsuit. Duke does not want to go there.

Just as serious a charge as rape in NC according to the AP.

The men are still charged with kidnapping, for allegedly holding the woman against her will, and sexual offense. Under state law, a rape charge requires vaginal intercourse, while sexual offense covers any sexual act. In dropping the rape charges, Nifong did not specify what sex acts prosecutors now believe occurred.
A defendant’s prior criminal record affects the length of a prison sentence in North Carolina. In the case of the three indicted players, Cheshire said rape and sexual offense carry the same possible sentence of up to 24 years in prison, while kidnapping is punishable by up to seven years.

One problem with Duke suing the city of Durham is that the vast vocal response of Duke officials to the charges were not in any way supportive of the accused. The Group of 88 was comprised of Duke faculty and shamefully gave no indication of any belief in "innocent until proven guilty". In fact, behind Nifong, the Group of 88 was probably one of the most responsible parties for fanning the flames of racial tensions in the area. Recently, some Duke faculty have poked their heads out from beneath cover and said some supporting things about the accused/negative things about Nifong, but early on, the sentiment on campus from those drawing paychecks was that these boys were so obviously guilty that it would be socially irresponsible not to call for them to be drawn and quartered - trial be damned.

They cannot sue the DA. DAs have immunity. He will get reviewed by the Bar, had they should at least take his license.
