What is even worse about the mistrail (seeing as how he came out "healthy") Is the fact that now the trial may push into spring practice and the season. Hopefully not distracting CW but how can it not Charlie works constantly on this team and if he has to fly to Boston for anything it will take him and his mind off ND football. I for one hope he settles.

you really can't ask the man to settle he almost died. I'm sure cw will have this team ready come the season.

The issue is not whether CW was "in bad shape." The issue is whether a standard of care was violated, and whether that caused the complications in question. Complications can and do occur every day, especially in intinsically high-risk procedures in high-risk patients. None of "us" know the specific details in question (unless you are sitting in on the trial or have reviewed CW's medical record, in which case you shouldn't be posting on a chat room forum). The physicians involved may actually be "heroes" for saving CW from life-threatening complications. Even the best of physicians may not be able to protect and save a 350 pound high risk individual suffering from a life-time of poor health decisions. They tried. Maybe they should have just told CW to put his head between his legs and kiss his ass good-bye. Then they wouldn't be on trial.

I know this is kinda a touchy subject, but I'm not even sure why he brought this to court to begin with. It's not like he needs the money or anything, and it seems like all these malpractice suits are half of what makes medical expenses so high. doctors have to cover themselves just in case. now obviously if there really was great negligence on the part of the doctors, I could understand... but in a high risk surgery, things happen all the time. I just think settling out of court or never bringing it up to begin with would have been better. but really, what do i know?

Its not about the money at all, its about whether these doctors screwed up and almost cost him his life. All surgeries have risks, that is true, but for him to suffer massive internal bleeding and it go unchecked long enough to cause permanent physical damage is more then enough grounds for a lawsuit.
And if Weis were to "never bring it up at all" and someone else goes to these same doctors and ends up tragically dying because they are negligent then don't you think Weis would feel bad knowing that he could have enlightened people to the actually skill of these doctors? Its not about the money its about protecting his rights as a patient and of future patients against potentially negligent doctors. I agree that frivolous lawsuits are a joke in most cases and should be thrown out of court without much regard but I think you have to look at each case on an individual basis, and to me this one seems like it has legitimate basis to go to court.

Yeah he came out healthy alright having lost feeling in his legs and feet, perfectly healthy. And by the way if you really think the worst thing about the mistrial is that it going to push into spring ball then you have very little compassion as a human and you are taking ND football way to seriously. Lets get our priorities straight and think before we type...geez.
