Silent Justice Thomas: Not a Word Spoken

WASHINGTON (AP) -- Justice Clarence Thomas sat through 68 hours of oral arguments in the Supreme Court's current term without uttering a word.

That's saying something - or not - even for the taciturn justice.

In nearly 16 years on the court, Thomas typically has asked questions a couple of times a term.

He memorably spoke up four years ago in cases involving cross burning and affirmative action, the court's only black justice in the unusual role of putting his race on display through questions to lawyers.

But the last time Thomas asked a question in court was Feb. 22, 2006, in a death penalty case out of South Carolina. A unanimous court eventually broadened the ability of death-penalty defendants to blame someone else for the crime.

Thomas has said in the past that he will ask a pertinent question if his colleagues don't but sees no need to engage in the back-and-forth just to hear his own voice.

A recent tally by McClatchy Newspapers underscored this point: Thomas has spoken 281 words since court transcripts began identifying justices by name in October 2004. By contrast, Thomas' neighbor on the bench, Justice Stephen Breyer, has uttered nearly 35,000 words since January.

The Georgia-born Thomas also has chalked up his silence to his struggle as a teenager to master standard English after having grown up speaking Geechee, a kind of dialect that thrived among former slaves on the islands off the South Carolina, Georgia and Florida coasts.

A new book about Thomas, "Supreme Discomfort," by Washington Post reporters Kevin Merida and Michael Fletcher, devotes an entire chapter to Thomas' courtroom reticence, calling it "one of his signature characteristics as a justice and a subject of ongoing fascination - both in the legal community and among the public at large."

I saw this on the Huffington Post. Which might as well come from a democratic press release. LOL
What's sad is the attempt to go after justices on the right, such as Thomas. It's funny how the ABA (which has lost all credability in many people's eyes) takes a dim view towards republican justices, as opposed to those on the left. He has been accused of being intellectually challenged, that he is unqualified for the job, lack a clue as to how the justice system works, and many more.
Some people, including justices, don't put much stock in oral arguments. This is not a normal criminal court case, or a simple civil matter. HE BELIEVES THAT MOST ORAL ARGUMENTS ARE UNNECESSARY. HE WOULD RATHER LISTEN TO THE ARGUMENT, rather than (like Breyer) break in very often and disrupt the attorney's train of thought. This could be construed as the cerebral method, as opposed to one of grandstanding.
What's sad is the utter hatred that the left has for those on the right. Don't like Bush, Cheny, Rove, Delay, Frist, Rumsfeld, Condo,or any justices. Hell, the left tried to drag the chief justice through the mud before they realized that he was a lot smarter than them.

My suggestion is stop the hatred already. It gets old.

Actually, what is worse is the fact that a former head of the ACLU was put on the supremes. I guess her ideology is ok, while the right nominees had better pass the 'proper' litmus test. Really sad. This whole thread is a joke.

Thomas is a scumbag. Maybe he's thinking about Anita Hill. That could be why hes not speaking. That whole ordeal was an embarrassment.

He was not tried or convicted of ANYTHING. That was a last second attempt to impugn his reputation and cause him to step down from his nomination. I'm glad it didn't work. If she had LEGITIMATE concerns about his behavior, it should have been brought up before, and not then.
Another case of being tried in the court of opinion, and not in the legal system. Kind of like Tom Delay. Who was tarred and feathered for little reason. I guess innocent until proven guilty doesn't matter much when it comes to politics.
BTW- If we all used the same standard, Bill Clinton is a disgrace for raping women during his time in Arkansas. Where was the outcry from the left or women's groups?? NOT!! Oh yeah, only those on the right are a disgrace. Like I said, this thread is a joke.

What are you talking about? This is simply a blatant fabrication.

Here are the Republican appointees. You will notice that even extremely conservative justices got UNANIMOUS well-qualified votes selections by the ABA.

Alito, Roberts, and Scalia are perfect examples.

The only two that did not were the jokers of the bunch.

Justice Samuel Alito, 2006, unanimous well-qualified.
Chief Justice John Roberts, 2005, unanimous well-qualified.
Justice Clarence Thomas, 1991, 12 votes for qualified, two votes for not qualified and one recusal.
Justice David Souter, 1990, unanimous well-qualified.
Justice Anthony Kennedy, 1987, unanimous well-qualified.
Robert Bork, 1987, majority well-qualified, four votes for not qualified. Bork was rejected by the Senate.
Justice Antonin Scalia, 1986, unanimous well-qualified.

It's not hatred, it's competence. So far the ABA has proven pretty accurate in it's assessment of him. His impact on decisions has been minimal. His deliberations a joke. He is a waste of oxygen...they should have just given Scalia two votes and saved money on the salary and cost of robes.

Wow, pretty harsh words for a Yale graduate. I'm a democrat and like Clinton so I shouldn't have to remind you about that whole ordeal. But on the the other hand since you're from Pa and a Ruddy fan are u from Dunmore.

The ABA has been proven to be a mouthpiece for the democrats. They have no credability. It's funny how the left views republicans...casting them either as incompetent or criminal. Now that is sad.

The ABA does not view them that way...they give top scores to ultra-conservatives all the time.

I don't see how that is a mouth-piece for the Dems.

Alito, Roberts, Scalia...all got unanimous top scores. No politically motivated Dem would have given them that.
