i hate to make this a first post... but i saw this on Profootballtalk.com. What does it mean and what do you make of it?




WEIS, IRISH FLIRTING WITH DISASTER?

A league source with intimate knowledge of the applicable NCAA regulations tells us that Notre Dame coach Charlie Weis might have rendered quarterback Brady Quinn and other incoming seniors ineligible if, as we previously have reported, Weis has directed the seniors with designs on pro football to pick their agents before the start of the 2006 season.

Rule 12.3.1 of the NCAA bylaws states that "[a]n individual shall be ineligible for participation in an intercollegiate sport if he or she ever has agreed (orally or in writing) to be represented by an agent for the purpose of marketing his or her athletics ability or reputation in that sport." Rule 12.3.1.1 elaborates on the general principle set forth in Rule 12.3.1: "An individual shall be ineligible per Bylaw 12.3.1 if he or she enters into a verbal or written agreement with an agent for representation in future professional sports negotiations that are to take place after the individual has completed his or her eligibility in that sport." So what does it all mean? If Quinn or any other of his teammates actually pick a football agent before the completion of their eligibility, their eligibility might be completed far sooner than they realized.

The key is that eligibility evaporates per Rule 12.3.1.1 even if there's only a verbal agreement between, for example, Quinn and agent Don Yee that Yee will represent Quinn, and that a written agreement for the representation will be signed later. Although it might be difficult for the NCAA to prove that there's a violation if Quinn and Yee mutually agree to claim that there was no agreement, the fact that Quinn is going through the process of interviewing agents and narrowing the field before his final season of college ball is strong circumstantial evidence of an intention to pick his agent while still otherwise eligible. The fact that Yee and others are participating in the process is likewise circumstantial evidence of an implicit agreement that they'll agree to represent Quinn, if picked to do so.

The broader question is whether the NCAA will dare to do anything that might result in killing the goose that lays beneath the golden dome. Our guess? The powers-that-be will stick their heads in the sand on this one, content in spewing the party line that no final selections have been made by any of the Notre Dame seniors.

Still, it's a risk that Weis would have been wise not to take, in light of the plain language of the relevant bylaws (unless, of course, he got advance approval from the NCAA that it's okay to tell his guys to pick their agents if they merely don't tell the agents they've been picked).

And what does Weis really gain by forcing the players to pick agents now? Although some league insiders think it's a brilliant strategy for minimizing distractions, it's also a possible means for fomenting resentment from players who would have preferred not to be rushed. Many factors still need to be determined, and an agent who looks to be the right choice in June might not ultimately be a player's best bet come January.

As one league insider told us on Sunday, "Weis isn't doing the kids any favors by sheltering them. He instead should be educating them so that they can make good decisions at the right time."

Indeed, the only college players who talk to agents during the seasons are the college players who want to. Really, why should Weis or any other coach tell the players that they can't use what little free time they have talking to potential agents?

Stay tuned. At a time when the media ripped ferociously into various scandals that emerged in April regarding USC, we figure that there's enough blood in the water to prompt a few of them to take a hard look at whether the efforts of Charlie Weis to minimize distractions have inadvertently created a big fat one

I can guarantee no student athlete at ND has made such an agreement verbal or otherwise. These are student athletes at Notre Dame!! While no person is free of making mistakes, these student athletes have been given the best advice available. I am sure that advice isn't to tell an agent i'm yours to represent after my senior season. The student may have chosen a short list but not the above suggested.

PFT while generally reliable has been wildly inaccurate at times. Also it should be noted (by them in the interest of full disclosure) that website is the work of NFL agents. Probably agents that don't have a chance at ND players or have a poor relationship with Weis

Whoever posted that is a USC FAN. Thats the most stupidest thing I've read. Charlie would never do that.

We're safe because they can never prove that anything happened if indeed, anything ever did happen in the first place; hopefully it didn't, that would really tarnish our reputation.

An interesting series of articles on the ProFootballTalk website regarding Weis's directive to seniors-to-be that they should choose agents before the season begins in order to minimize distractions. It's an interesting approach, but one that seems quite dangerous.

If I remember correctly, wasn't the thought of the Quinn's to just narrow down there list. I remember reading that the plan was to look at agents, and have it down to about 3 potential agents by the time the season started.

I'm pretty sure Quinn knows he can't get an agent right now though. It's a pretty universal rule that everybody knows about.

I believe you are right, but I sure hope he was really careful in all of this.

ND has a solid compliance office, so I think this is a rumor and nothing else. But I sure hope there is some sort of verbal statement poo-poohing this...just to settle my stomach.

lets not forget that CW was in the NFL for a long time and knows all about agents and when a player can/cann't sign with an agent. CW wouldn't be this careless....lets remember that this is ND not OSU or USC.

Also the article that I read stated that it was Brady's family talking to the agents, not Brady.

Yeah, Team Quinn. Two uncles, his parents, and Quinn.

I think they Parents and Uncles are reviewing them...Brady makes the final call.

Although...I thought I read that Quinn had talked to them...hmmm

While I don't give too much credence to this story, I do worry just a bit...

i don't worry in the slightest. the other boards are running with this like ND is in trouble. let's not perpetuate that sort of false thinking here. a guy can interview a billion agents at any time in his college career. he just can't sign with one until he's done playing.

there's no controversy here, no ethical dilemmas. similar to a high school coach that encourages a kid to verbal to a school prior to the start of his senior year to cut down on distractions, weis has encouraged his guys to acquaint themselves with the process while they have the time to devote the attention to it. and just like the blue chip recruit that waits to sign his letter of intent until national signing day, weis' guys will wait to sign with an agent until they finish the 2006 campaign.

this is a non issue manufactured to generate buzz during the dog days of summer leading up to the start of the season. laughable.

I automate pulling breaking news for the sake of conversation.

I think the writer of that article is just jumping the gun and has no knowledge of the situation whatsoever.

If any of this had any merit it would be all over the media outlets, but the only place I've seen it is on that website.

it is also on the cnnsi.com website in their truth and rumors section. But I have looked everywhere and profootballtalk.com and cnnsi.com are the only two that I could find it on.

While I put NO credence in this rumor I can just imagine how much pressure is being put on Quinn and his family in this situation. Sports agents are vicious people and they care little if the athletes are harmed in any way, especially if they are "on the outside looking in".

We have to remember that the authors of this type of garbage are all college graduates and the vast majority hate ND. It is easy to start a rumor, the source of which cannot be proven. Look at the attention this nonsense has gotten on this site!

Having said all this I still think there should be some kind of a statement from ND debunking this. If not it will continue to be out there. ( I have already gotten 5 e-mails from friends asking for comments).

A Web site is reporting Brady Quinn and other Notre Dame players have violated an NCAA rule regarding hiring an agent.

Notre Dame responded Monday to allegations by Profootballtalk.com that quarterback Brady Quinn and other potentially NFL-bound seniors could be deemed ineligible because Irish coach Charlie Weis told them to pick an agent before the season.

Notre Dame associate athletic director for compliance Mike Karowski called it “far-fetched.”

Quinn had been narrowing down potential professional agents, but that is not an NCAA violation. Players and agents can speak, but if no oral or written agreement is agreed upon and no gifts are given, the player’s eligibility remains intact.

“Did I find it a little ridiculous? Yeah,” Karowski said Monday when asked about the allegations. “No one from the site has called me or Charlie or anyone else asking how anything is handled.”

Karowski said he has met with coaches, players and their families to discuss how to handle the agent process and stressed this specific rule.

“We told them they can’t make the final decision or any overtures,” Karowski said. “Are some of our kids working with a list of 10 as opposed to 30, sure, it’s permissible.”

Still, Quinn has been looking, and Profootballtalk.com has reported that Don Yee – who represents New England quarterback Tom Brady – is the front-runner for Quinn. It also said that Weis told his players to make their agent selections before the season starts to limit distractions and should they do that, the players would become ineligible.

A message left by the Journal Gazette with David Slates, Quinn’s uncle and a member of the group of people in Quinn’s inner circle regarding his future representation, was not returned Monday.

Despite all the jostling, Notre Dame said its players have done nothing more than speak with agents to gather information.

“We have every confidence that Charlie knows the rules, has communicated the rules and that our compliance people are in complete concert as to what can be done and what can’t be done,” Notre Dame associate athletic director for media relations John Heisler said.

Weis could not be reached for comment Monday, Heisler said.

Profootballtalk.com is a rumor mill site focusing on the NFL run by Mike Florio, a former league insider for ESPN, according to a 2004 Washington Times story. Florio’s Web site is considered to be a cross between opinion and information – although some NFL beat writers take what Florio writes seriously, as he has beaten reporters on stories in the past. Besides running the Web site, he is a West Virginia-based lawyer.
