    What does name, image and likeness mean? What is the right of publicity?


    Name, image and likeness (or NIL) are the three elements that make up “right of publicity”, a legal concept used to prevent or allow the use of an individual to promote a product or service. For example, if an athlete’s photograph is taken while wearing an athletic brand, and that brand uses the photo to promote their products without the athlete’s consent, that athlete could claim the brand is in violation of the right of publicity.

    The right of publicity is generally used to protect against the misuse of an individual’s name, image and likeness for commercial promotion. However, the NCAA has been scrutinized for years, as critics say the NCAA takes advantage of student-athletes by using their name, image and likeness for profit, while not allowing the athletes to cash in, as well.

    With the NCAA changing the existing NIL rules to begin allowing athletes the right to profit from the use of their own name, image and likeness, here are a few examples of what student-athletes could now be paid for:
    • Their autograph
    • Developing and/or modeling athletic and non-athletic clothing apparel
    • Promoting products and services
    • Making personal appearances

    How can I earn money from my NIL?


    Below are some examples of how student-athletes could make money from their NIL
    • Lessons, camps and clinics
      • Example: An LSU football player can host a summer camp for youth football athletes, in which he receives some or all of the profits. But when using his name and image to promote the camp, the athlete cannot reference LSU or wear any LSU gear.
    • Product endorsements:
      • Example: A collegiate swimmer can be compensated for a partnership with Speedo to promote the latest competition suit, as long as the promotion does not mention the name of the swimmer’s college/university.
    • Autographs. These sessions cannot occur during an institution event or competition and no school’s trademarked logos or apparel is used during the sale of the material.
      • Example: A local organization can hire and pay a college baseball player to sign autographs during a youth baseball event. At the event, the athlete is not permitted to wear his college/university’s apparel.
    • Fundraising
      • Example: A college soccer team can create a crowdfunding page to help a teammate financially whose family is experiencing a personal hardship or to raise funds for a charity.

    How much money will student-athletes be able to earn?


    With college athletes soon able to profit from their NIL, you might be wondering exactly how much these athletes can earn once the NCAA adjusts their current rules and regulations. While earning potential varies from athlete to athlete, ESPN recently broke down the earning potential for four different categories of college athletes to give an idea of how much money is up for grabs.

    The four athlete categories ESPN identified are All-American and Olympic athletes, as well as athletes competing for revenue and non-revenue driving sports. Looking at the various types of earning scenarios, ESPN estimated a profit range for each athlete category. Unsurprisingly, it’s estimated that All-American athletes have the highest earning potential in every category, with as much as $1M for social media promotion, $20k per camp/lesson, $500k for commercial appearances and $500k for apparel deals.

    It’s important to remember, very few college athletes fall under the All-American category. Instead, the vast majority of student-athletes compete on a non-revenue sports team, which is the category with the lowest estimated earning potential. But this doesn’t mean non-revenue athletes won’t have any opportunities to take advantage of the new NIL rules. For these athletes, the largest earning potential lies in camps/lessons. ESPN estimates that athletes could make a couple hundred dollars per day working at camps and between $35 and $50 per hour for individual or small-group lessons. While the NCAA does currently allow athletes to be paid to work at camps, the proposed NIL rules would allow them to promote their presence at a camp using their school name on promotional materials.

    While the above provides an estimation of how much money student-athletes could potentially earn, we can look at college cheerleading for an idea of how much student-athletes make when they are not regulated by NCAA rules. College cheerleaders are not governed by the NCAA, meaning they have long been able to participate in endorsement deals. Over the years, college cheerleaders have earned money selling autographs, making commercial appearances and promoting products on social media, all of which are ways NCAA athletes may soon be able to earn money. A recent New York Times article took a deeper dive into the various endorsement deals college cheerleaders profit from each year and how these opportunities have impacted their careers.

    NIL restrictions


    The NCAA listed the following protective measures to monitor and regulate any potential student-athlete NIL compensation:
    • NIL compensation cannot be used as a form of payment for athletic participation. In other words, NIL opportunities should not be used as a recruiting tactic.
    • Schools and conferences cannot play a role in their student-athletes’ NIL activities.
    • Student-athletes cannot profit from use of their NIL in situations where they have no legal right to demand such compensation (i.e. when the athlete’s school trademarked logos are used).
    • The role of third parties in student-athlete NIL activities is regulated.
    • NIL rules cannot interfere with NCAA members’ efforts in the areas of diversity, inclusion or gender equity.

    Will the NIL rules be different for each NCAA Division level?


    Yes, each division level has been asked to create their own NIL compensation plan using the guidelines and recommendations the NCAA Board of Governors approved. Because all three NCAA divisions have different rules in terms of recruiting, scholarships, etc., each division level will implement their own NIL rules changes.

    How will these rules apply to recruits?


    As a result of changes to NIL rules, it’s possible that the NCAA will enforce stricter recruiting rules to prevent college coaches from leveraging NIL compensation to influence recruits. While we do not know exactly what this looks like, the NCAA has made it clear they’re dedicated to maintaining a differentiation between college athletes and professional athletes.

    Additionally, the NCAA has called on Congress to take steps that would allow the association to navigate the potential challenges that come with modernizing the NIL rules.

    “The evolving legal and legislative landscape around these issues not only could undermine college sports as a part of higher education but also significantly limit the NCAA’s ability to meet the needs of college athletes moving forward,” Michael V. Drake, chair of the board and president of Ohio State said. “We must continue to engage with Congress in order to secure the appropriate legal and legislative framework to modernize our rules around name, image and likeness. We will do so in a way that underscores the Association’s mission to oversee and protect college athletics and college athletes on a national scale.”

      It’s funny how he says it’s about to be an arms race. As if it wasn’t already. For schools like Bama this will just be another form of it.

      Freeman at ISD is saying that ND is going to come out with something this month to push NIL and geographical recruiting since they can’t be on the road.

      A lot of recruits are already talking about this so hopefully ND is getting ahead of it like others.

          Id like to think with the Mendoza Business school in play and alll the (gloabal) connections available to student athletes at ND... branding and maximizing NIL should be an esy win for ND..... right Coach Kelly?

                I'm pretty sure ND is already working with players on building "brands" so they can monetize their social media presence and do some other things with their own individual returns when the time comes.

                I know ND is also already using billboards with current players to market in certain regions, and I'm sure they'll find a way to incorporate that as well.

                I wouldn't expect ND to be too far behind... they've got the brains and institutional impact to make it work, and it seems like the ND communications department is on the ball with making sure current players are involved and visible with everything they do. Now they just need to make sure they have the recruiting slideshow ready for when it's on legal and on the books, and they can show an expected ROI not just for the degree, but for their social media/autograph/advertising opportunities, as well.

                      I could see "big market teams" having serious advantages. Imagine 5 years down the road GT players having more ad opps in ATL over UGa guys in that sleepy little village of Athens.

                      Texas can crush Bama (everyone?) here. More alums, more affluent alums, more population of affiliated fans and huge, growing markets. Birmingham would be the 5th largest market in TX.

                                        Irish coaches will be calling 15 to 20 schools in their recruiting areas every day. You can find out where they're at on Twitter.



                                        Notre Dame will also look to capitalize in areas where they’ve already had success releasing videos from current players from respective areas why they chose Notre Dame. Billboards will pop up around the country of heavily populated cities of current players and signees.

                                        They’re already up in St. Louis and Indianapolis among other areas.



                                        On the billboard Notre Dame is promoting their players Twitter accounts as a plan is in place to help build their player’s brands with the new Name, Image, Likeness bill that should pass shortly. Notre Dame would certainly be one of the programs nationally to benefit the most from that.

                                        “We’re anxious to get a ruling from the supreme court,” Kelly said. “The branding opportunities here are exponential.”

                                        The stage the Irish play on is unique to many of their peers in college football backed up by the TV Ratings. Three times last season ND had the most watched game in college football as matches against Duke, Clemson and Boston College ranked No. 1 that week per sports media watch. Two other times the Irish played in the No. 2 watched game, vs Louisville and against vs Clemson in the College Football Playoff.

                                        “We’re not an off Broadway program,” Kelly said. “We’re on Broadway, we play under the bright lights.”

                                        Notre Dame never played in a game that ranked less than six in that category nationally throughout the season.

                                        Kelly pointed towards winning consistently certainly helping with opportunities for playing branding as ND has won at least 10 games in each of the last four seasons with two trips to the College Football Playoff. Over that same span 24 players have heard their name called in the NFL Draft. Eyeballs on on the program and virtual recruiting this spring will put another spotlight on the Irish.

                                              How do send ideas to their recruiting department? Maybe this is technically a flop but if they want to redirect billboard ads to player's social accounts, they should look at adding a barcode to the billboard that people can scan as they pass-by. These could go to the entire account or highlight videos specifically curated to show the work these players have put in. Just a suggestion to continue taking it to the next level for the players and build on this already massive step.

                                                Wonder why Tommy is looking at Kansas to start. I found there’s a 90 type rating QB for 2023 (but not from Kansas City) there but not much more ranked by 247 in 2023. I think a few MO/KS border kids are decent prospects on D

                                                          Given the stature of ND nationally, there's no reason ND shouldn't win this war. This is one tool that can bring a more level playing field when it comes to recruiting.

                                                                                      I can see Indiana moving fairly quickly on this. Years ago Indy developed their city plan around hosting major sporting events. I don't remember specifics, but some of the plan required state approval. One of the architects of this was a guy by the name of Jack Swarbrick. Obviously this would benefit more schools than just ND, but I can see Jack working his connections to make this happen.

                                                                                          I just saw Baker's on the way back from the airport. As a former ad exec, I question the font size, color selection and intended call to action for a billboard campaign BUT this is a multi-media play and we'll see if that has legs. Day one... it was a huge on twitter. A TON of talk by other program followers about it.

                                                                                          IF adding substantial followers for the players on twitter or IG were the point of the buy, the ROI will be poor. But it's still brand building even if it's not instantly monetizable by the player.

                                                                                          But for pure swag effect on current/future recruits and the hype it's creating as ND goes out on its May road blitz, it's off to a great start.

                                                                                          *** BTW: I checked out Tosh's Twitter following yesterday and it was at 1396. Today, it's at 1401. 3 local and two from out of market. Now all of them may have come across this because he's trending or the locals may have seen his billboard and looked him up. The driver is undefinable. Will be able to follow adds to his Twitter this way.

                                                                                          Also: Got a front page news story in the AZ Republic / AZCentral.com by my guy Richard Obert who handles HS sports. That's additional reach as a result of the campaign.

                                                                                            One thing I'll say -- this is going to piss off State School U and certainly create turf wars. I think most people realize this, but your Tier 2 or Tier 3 state schools (Virginia Tech, North Carolina, Illinois, Indiana, Pittsburgh, etc.) already HATE losing kids to Notre Dame. When that happens for reasons like "academics" they suck it up... but if you come into their back yard, put up billboards, and then take a prized recruit that's something they're not going to want to stomach.

                                                                                              Now we just have to wonder whether the billboards were supposed to drive the interest or whether they were meant to drive news and social media intention. If its the former, then it probably wasn't a great campaign. If its the latter, its some really smart marketing work. So, are our marketing people really smart or did they just get lucky with a bad campaign?

                                                                                                We need to work with NBC to get stuff like that on screen during games. Maybe its too difficult to use different ones for relevant players during the game, but at the very least we should be getting a QR code that links to a roster that then can link to players' social media accounts.
